5885 Utility Imp Hageman Park1 1 -_-- - _- _-- ORDINANCE NUMBER 5885 L_CN SOLT D,'. .-`D-SALK;,`, (Published in the Salina Journal /"TVCoS4 13 , 1954) AN ORDINANCE creating and defining a certain Main Sewer District in the City of Salina, Kansas, designated as Main Sewer Z, providing for the construction of a Main Sewer in said district; providing for the payment of the cost thereof and for the levying of spea.al assessments against the property in such district for the pay- ment of such cost, and for the issuing of bonds therefor. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Main Sewer District "Z". That there be and there is hereby created, a Main Sewer District in the City of Salina, Kansas, which shall be designated as Main Sewer District "Z", which shall include all the following described property in said city, to -wit: BENEFIT DISTRICT -MAIN SEWER "Z" – – – – – – – – – – – – – – – – Tract No. 1. A part of the Southwest Quarter of Section Eighteen, Township Fourteen South, Range Two West of the Sixth Principal Meridian in the City of Salina, Saline County, Kansas, described as follows: The South 150 feet of that certain tract beginning at a point Fifty Feet East and Thirty Feet North of Southwest corner of said Southwest Quarter, thence east and parallel to south line of said Southwest Quarter Two Hundred Feet, thence north and parallel with the west line of said quarter section to the center of the Smoky Hill River; thence down the center of said Smoky Hill River to a point Fifty Feet east of the west line of said Souhwest Quarter Section; thence south and parallel with the west line of said South- west Quarter Section to the point of beginning. Tract No. 2. The Northeast Quarter of the Northeast Quarter of Section Twenty Four, Township Fourteen South, Range Three west of the Sixth Principal Meridian in the Citi of Salina, Saline County, Kansas, except the east fifty feet thereof. Tract No. 3. The East Two Hundred Feet of the West Two Hundred Fifty feet of the Northwest Quarter of Section Nineteen, Township Fourteen South, Range Two west of the Sixth Principal Meridian in the City of Salina, Saline County, Kansas. Tract No. 4. Lots 1 to 18, inclusive, all in Ostenbergs Replat of part of Blocks 1 and 2, Hageman Park Addition to the City of Salina, Saline County, Kansas. Tract No. 5. The East 1 of Blocks One and Two and all of Blocks Seven and Eight, all in Hageman Park Addition to 'the City of Salina, Saline County, Kansas. Tract No. _6. Lots 1 through 20, inclusive in each of Blocks 1, 2, 3, and in the Replat of Blocks 3, 4, 5, and 6, Hageman Park Addition to the City of Salina, Saline County, Kansas. Tract No. 7. All of Blocks 6, 7, and 8 in Claflins Addition to the Grounds of Kansas Wesleyan Univerlity, in the City of Salina, Saline County, Kansas. Tract No. 8. Lots 1 through 18 inclusive in each of Blocks 2, 3, amend -5 and Lots 1 through 22 inclusive in Block_, all in the Replat of Blocks 1, 2, 3, 4 and 5 Claflins Addition tote City of Salina, Saline County, Kansas. Tract No. 9. Lots 1 through 20 in each of Blocks 1 and 2 in the Bailey Heights Addition to the City of Salina, Saline County, Kansas. Tract No. 10. Lots 1 through 18 in each of Blocks 1 and 2 in the Wymore Addition to the City of Salina, Sal -he County, Kansas. Tract No. 11. The East Two Hundred Feet of the West Two Hundred Fifty Feet of the Northwest Quarter of the Southwest Quarter of Section Nineteen, Township Fourteeen South, Range Two West of the Sixth Principal Meridian in the City of Salina, Saline County, Kansas. Tract No. !_,;�. The East Two Hundred Feet of the West Two Hundred Fifth Feet of the North One -Half of the Southwest Quarter of the Southwest Quarter of Section Nineteen, Township Fourteen South, Range Two west of the Sixth Principal Meridian in the City of Salina, Saline County, Kansas. Section 2. That it is necessary and it is hereb ordered that a Main Sewer District, together with all necessary connections, Manholes and other appurtenances, be constructed and built as Main Sewer District "Z", along the following described course within said district, as follows: A 12 inch clay pipe sewer beginning at an existing manhole which is 10 feet west of the center line of Ohio Street and east of the center line of utility easement first north of Crawford Avenue; jthence south parallel to and 10 feet west of the center line of Ohio to the center line of McAdams Road, where a manhole will be j constructed, with a branch line beginning at said manhole and extending west with an 8 inch clay pipe sewer to the center line of Pearl Avenue where the branch line will terminate, and beginn- ing at manhole to be so constructed in McAdams Road and Ohio Avenue and extending south with a 10 inch clay pipe sewer to the center line of easement extended east first north of Claflin Avenue, there a manhole to be constructed which will be the term- inus of Main Sewer j f Section 3. That the City Engineer shall on or before the 'Ic day of 1954, prepare and file in the office of the City Clerk, i plans and specifications for the construction of Main Sewer "Z", provided for in the preceding section of this ordinance, which shall be of the proper character and along the proper course and at the proper grade to serve the property lying within the district within which such sewer is to be constructed, and shall on or i before the same date, prepare and submit to the Board of Commissioners, a detailed I estimate, under oath, of the cost thereof, and that thereafter the City Clerk shall j advertise for three consecutive days in the city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, i which proposal shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest responsible bidder or bidders therefor; ; provided that the cost thereof shall not exceed the estimated cost thereof and pro- vided that shall Board shall reserve the right to refuse any and all such proposals; and that if no responsible bids shall be received within said estimated cost, said Board may proceed and build such sewer within such estimated cost. Section 4. That for the cost of building and constructing such a sewer, special assessments shall be made for the full cost thereof, on all lots or pieces of land within the Main Sewer District wihhin which such main sewer shall be built according g to the appraised value thereof, without regard to the improvements or buildings i thereon. Section 5. After the passage and publication of this ordinance, the Board of after Commissioners shall appoint three disinterested appraisers who/having taken an oath to make a true and impartial appraisement of all lots or pieces of land liable to taxation forthe cost of such improvements, shall within five days after having been notified of their appointment proceed to appraise all of the lots or pieces of land 1 1 within such district, liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making said appraisements shall return the same to the Board of Commissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too I high or too low. i Section 6. The special assessments herein provided for may be paid by the i person liable therefor in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property, pay the same in full and his property shall not be liable for any assessment for the cost of such improvements I j and bonds as hereinafter provided for shall be issued for the amount of the cost of i such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improvements in this i ordinance provided for, the Board of Commissioners are herby authorized and directed I to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improvement, and to run for a period of four years and be payable in four approximately equal annual installments, together with interest not to exceed five I per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paying the principal and interest on said bonds as they severally I become due and payable, the Board of Cormissioners shall apportion and assess against the lots or pieces of land within the taxing district of such improvements, special assessments covering the cost of such improvements and the apportionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with said improvement, such assessment and apportion- ment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and i improvements, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for the one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected. Section 8. This ordinance shall take effect and be in full force from and after its publication once in the official city paper. -ON SO LIDA T.T.
