5877 Canopies- - - --- ORDINANCE NUMBER - - 827 s, '�' Published in the Salina Journal c — - -- = ---_-------- l) � L 19 54 ) AN ORDINANCE regulating the construction, erection, alteration, use and maintenance of awnings, suspended canopies, supported canopies, marquees and permanent awnings over the streets and alleys of the City of Salina; the construction, erection and maintenance of venetian awnings wherever located in the City of Salina; providing for the issuance of permits for the erection of such structures; providing for per- mit fees; providing penalties for the violation of its terms; and amending 6-252 and 6-253, Revised Ordinances of the City of Salina, 1948, andprov di gcforns the repeal of said Sections 6-252 and 6-253. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. AMENDMENT. That Sections 6-252 and 6-253, Revised Ordinances of the City of Salina, Kansas, 1948, be and it is hereby � Y amended to read as follows: i "6-252" CLASSIFICATIONS AND DEFINITIONS. In the construction of this ordinance the following classifications and definitions shall' apply: i i Awn---ing•I A roof -like shelter carried by a supporting frame or armsattached to a building and so arranged that the shelter and frame may be folded or rolled i up to the face of the building to which it is attached. I Venetian Awning.i An awning, shutter or louver of metal, wood or other rigid material fabricated into sheets, strips or slats somewhat similar to a Venetian blind, erected to shade or form an outside protection to a window, door or other building opening. I Suspended Cano � PY A covering of canvas or other combustible material rigidly I supported by a metal frame attached to a building and suspended over an entrance solely for a shelter or for protection. i Supported Canopy A covering of canvas or other combustible material used j solely for temporary shelter for a door or walk and carried by a frame supported I I by the ground or sidewalk. I j Mar__quee. An overhanging flat roof -like protection or covering of rigid i g material and construction. Permanent Awning, A sloping roof -like projection of light weight rigid con- struction supported from a building without Posts and used for the outside protection of a door, window or other opening. i I i Any construction, erected primarily for shade or protection from the elements and which projects into any public area or is liable to endanger g persons using ' public streets or alleys, and which is not mentioned or defined specifically herein or about which there is any y question, shall be classified by the Building Inspector. 2 SECTION 2. "6--252" PERMITS AND PERMITTEES. No supported canopy which is to be in place more than 24 hours and no suspended canopy or marquee shall be added j to, altered or erected over the streets, sidewalks or alleys of the City of Salina until a permit has been secured from the Building Inspector. P The fee for such per- mits shall be Two Dollars. No awning or permanent awning shall be added to, altered or erected over the streets, sidewalks or alleys of the City of Salina until a i per- mit has been secured from the Building Inspector. The fee for such permit shall be I i Only Two Dollars. Such fees shall be paid prior to the issuance of the Permit or i the erection of the suspended or supported marquee, awning or permanent awning, - -- - -- ---- — - CONS01.1-mTLD-S.+LIN_ _. -.. SECTION 3. "6--252" REGULATIONS. The following regulations shall apply to all construction and maintenance of awnings, permanent awnings, venetian awnings, suspended canopies, supported canopies and marquees: AWNINGS --MISCELLANEOUS REQUIREDMENTS: Awnings over public areas in the City of Salina shall be arranged without posts and shall provide a clearance of not less than seven (7) feet from sidewalk to the lowest point of frame work, and no part of such awning cover, including any fringe, apron, skirt, valance or drop, shall i be less than six feet six inches (616") above the surface of the sidewalk immediately below when the awning is lowered for use, except the bottom of awning covers enclosing the ends of awnings shall be not less than six feet eight inches I I (618'1) above the surface of the sidewalk. No awning less than fourteen feet (141) above the street, alley or sidewalk shall be closer to the vertical plane of the curb than two feet (2 ) and in no case shall an awning g project from the face of i the building more than eight feet (81). i All fixtures such as lateral arms, center supports, gears and pin ends must be fastened to steel backing where available � , by drilling and bolting through from the back when possible, or drilling, tapping and fastening with not less than three -eights inch (3/8") machine bolts. Where wood backing only is available, bolt through from the back wherever possible, using large washers under heads of i bolts; otherwise use lag screws from front at least four inches4" ( )long. When anchorage is to be made in brick, stone or terra cotta use approved pproved expansion bolts. Lock washer to be used on all bolts. i Every awning shall be rolled or folded aginst the building except when serving as a protection from sun, rain, snow or other inclement weather. FABRIC -COVERED AWNING CONSTRUCTION. Pipe rollers shall be no less than one i and one-half inches inside diameter galvanized steel pipe, or one and one-half inches outside diameter seamless steel tubing. j g• On pipe rollers over twenty feet in length where it becomes necessary to join two or more sections together, splicing must be effected by using cast steel gudgeons, roller ends to be r � p operly riveted to same. This also applies to pin end gudgeons. Metal rollers shall be drilled or perforated with holes of a size to make a driving fit with roofing nails (about one-eighth inch). These holes to be spaced not over three inches center to center for the first three holes on each end, spacing between to be approxiaately six inches center to center. Fabric covering shall be attached to metal roller by means of large -headed roofing nails fitted solidly into these holes. When using steel rollers, no center supports shall be necessary on awnings under twenty feet (201). Over twenty feet, center supports shall be spaced as follows: Awning lengths.... ............. 20M to 30' 30' to 4o' 4o1 to bot Number of supports necessary... 1 2 3 ' And one additional center support for each additional fifteen feet or fraction thereof. CON SOL 17. 1 1 On awnings having an extension of four feet or more from point of fastening on building, three-fourths inch inside diameter galvanized pipe extension arms shall be used. No extension bars ahll be used less than five -eights inch in diameter and shall be galvanized. Two arms shall be used for awnings not over twenty feet in length. On awnings over twenty feet, a center arm must be provided for each additional eight feet or fraction thereof added to the length of the awning. Awnings suspended on lateral arms shall required number of arms as per following sehedule: Awning lengths .................... o' to 22' 22'to 30' 301to 4O' Number of arms required........... 2 3 4 And one additional arm for each ten feet or fraction thereof thereafter. Wherever possible an even number of lateral arms shall be used. Front bars shall be galvanized one inch inside diameter or Grade "A" Clear Fir or comparable timber dressed to size 2" x 3" and corners properly leveled. Roller awnings shall be operated by self-locking, steel cut, worm type gear fixtures. Roller sprocket wheels and link chains not permitted. The design, construction and erection details of all awnings, other than those herein specifically provided for, shall be submitted to the Building Inspector for approval before erection work is started VENETIAN AWNINGS. No awning, shutter or louver of metal, wood or other rigid' material shall be erected or maintained in such a way that it will impede the entrance into the building of members of the Fire Department, or in such a manner that it will bar the way of persons seeking to excape from fire or panic in a building, and no shutter or louver of this type shall be placed in any opening giving access to a fire excape or other intended means of escape. No fixed frame shall be placed on any window or door opening in an assembly hall or public building hallway in an apartment or hotel building, but nothing shall prohibit the erection of such an awning on these openings provided they can be opended as provided in the following paragraph. Any awning, shutter, or louver of metal, wood or other rigid material attached to the windows of :k a building above the first story shall be arranged in such a manner that it may be easily opened so as to afford easy ingress and egress, and such awning, shutter or louver shall be constructed so that it may be easily =Bid opened from both the inside and outside without any special tool and without special knowledge or skill. No awning, shutter or louver of metal, wood or other rigid material weighing over one pound per square foot shall be attached to the wood jambs, frames or other wood members of a building (frame buildings excepted) when such building is within ten feet of public property. All venetian awnings erected above the first story shall be equipped with at least one safety chain securely fastened to the awning and frame. -- - Suspended canopies shall be supported throughout by metal framework. They may extend over public sidewalks or parking portions of a public street to a distance not to exceed twelve feet but in no case shall the outer edge of a suspended canopy be closer to the vertical plane of the curb than two feet and in no case shall it be over ten feet in width measured parallel to the building. The ground area of a suspended canopy shall not exceed ninety square feet. All such suspended canopies shall be securely and rigidly supported and maintetned so that no part i of the frameworks of such r suspended canopy py shall be less than eight feet above the surface of the sidewalk immediately below and no part of such canopy covering, including any fringe, apron, skirt, valance or drop shall be less than seven feet, three inches above the surface of the sidewalk immediately below. A supported canopy may be erected for a period of not to exceed seven days when approved by the Building Inspector, provided the fee is paid and the permit is secured. Provided, however, a supported canopy may be erected for a period i of not to exceed 24 hours and no permit or fee will be required. All supported I ' canopies shall be adequately supported and braced and shall be safely maintained and well lighted at night, and the abutting property owners shall save the City of Salina harmless from all claims of ever kind or nature arising out of the j erection, use and dismahtling of such canopy over public property. XMMUPHME Marquees extending over public property shall have their main framework and support of non-combustible material and shall be designed by a I ! structural engineer and approved by the Building Inspector. They shall have a clearance of at least eight feet above public property, and shall not extend i closer to the vertical plane of the curb than two feet. The roof shall be so drained as not to discharge water upon the sidewalk. Permanent Awning, extended over public property shall be of rigid construction, so designed that the roof portion shall be partly open to insure release of air i pressure built up under the awning. The structure shall be well braced and securely fastened to the building to which it is attached. The method of construction I and attachment shall be approved by the Building Inspector. No part of any permanent awning shall be closer to the public walkway below than seven feet nor shall it extend more than eighth feet from the face of the building to which it is attached. No awning of this description within fourteen feet of the walkway shall j be closer than two feet from the vertical plane of the curb. Section 4. "6-252" GENERAL. Provision shall be made that suspended or supported canopies, permanent awnings, or marquees shall not interfere with fire escapes or with public utilities. I Section 5. "6-252" ALLEYS. All awnings, i g , permanent awnings, canopies and marquees which project over public alleys shall, in addition to complying with the i requirements provided for in Section 2, be at least fourteen feet above the surface of the alley imiediatelybelow. CONSOLIDATED-SALIN A SECTION 6. 116-252" EXCEPTIONS. The provisions of this ordinance shall not apply to awnings, marquees or canopies heretofore erected in accordance with ordinances then in effect, but when recovers, renewals, :replacements, repairs or structural changes are made to such awnings, canopies or marquees, they shall be brought into full compliance with the provisions of this ordinance. SECTION 7. PERMITS REVOCABLE. Any permit granted to erect awnings, permanent awnings, canopies or marquees or portion thereof so as to project into a public street or alley is revocable by the City of Salina, when in the judgment of the Board of Commissioners of the City of Salina it is for the best interest of the City that such permits be revoked. i SECTION 8. PENALTY. It shall be unlawful for any person, firm or corporation to construct, erect, enlarge, alter, repair, use or maintain any awning, Venetian axning, suspended canopy, supported canopy, marquee or permanent awning conte j trary to any provision of this ordinance. Any person, firm or corporation violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be fined not less than five dollars and not more than fifty dollars for each offense, and each day of violation of this ordinance shall be considered a separate offense. SECTION 9. SAVING CLAUSE. In the event any part or provision of this ordi- nance is held to be illegal or void, such action shall not have the eJ2�ct of making Sri void or illegal any of the other parts or provisions hereof, which may or shall I be determined to be legal, and it shall be presumed that the ordinance xkmmwould have been passed without such illegal or invalid part or provision. SECTION 10. EFFECTIVE DATE. This ordinance shall take effect and be in force from and after its passage and publication once in the official city paper. SECTION 11. Sections 6-252 and 6-253, Revised Ordinances of the City of Salina, 1948, and all other ordinances and portions of ordinances inconsistent herewith are hereby repealed.
