5872 Driveway/Recess Parking00INANCE NUMBER _- - - - - -- - - 5872 - -- ----- CON SOL'r,"_rFD SAL.1N A __Published in the Salina Journal 19541 — — AN tRDINANCE amending Chapter 23, Article 3, Section 7 (c) of Ordinance No. 5823, 1948, Revised Ordinances of the City of Salina, Saline, County, Kansas, as amended, providing for and regulating street curb cuts and the construction and use of driveway approaches; and repealing Chapter 23, Article 3, section 7 (c) of Ordinance No. 5823, 1948 Revised Ordinances of the City of Salina, Saline County, Kansas, as amended. 1 r� BE IT LMAMM by the Board of Commissioners of the City of Salina, Kansas: Section 1. Article 3: Section 7. Width and location of driveway approaches and recessed parking areas. The following limitations on the width and location of drive- way approaches and recessed parking areas for each parcel of land shall be complied witht (a) No portion of a driveway approach, except the curb return, shall be constructed within six (6) feet of a corner. (b) No portion of a recessed parking area, except the curb return, shall be constructed: (1) Within twenty-five (25) feet of a corner if the vehicles moving in the directionof traffic flow on the side of the streeton which the driveway approach is to be situated are required to stop for a stop light or stop sign at such corner; and (2) Within twenty (20) feet of any other corner. (c) No driveway approach shall be less than eight (8) feet nor more than twenty (20) feet in width at the outside sidewalk line, and the curb cut shall not exceed the width of said driveway approach at the said outside sidewalk line by more than six (6) feet. Provided, however, that the City Commission -,shall be empowered to grant special exceptions to the above and foregoing limitations. The granting or denial of such special consent by the City Commission shall be predi- cated upon the calculated additional hazard to the general public as a consequence of allowripg such exception in each particular case. (d) There shall be not less than one curb parking space between any two driveway approaches or recessedparking areas in the "D" Local Business District, "E" General Business District, "F" Light Industrial District and "G" Heavy Industrial District as the limits of these districts are now or may hereafter be defined by Ordinance No. 5549 of the City of Salina (e) No recedsed parking area shall be permitted without the express consent of the City Commission that is wider than fiftjr (50) feet at the outside sidewalk line. The granting or denial of such special consent by the City Commission shall be predicated upon the calculated additional hazard to the general public as a consequence of allowing a particular recessed parking area to be greater than fifty (50) feet in length. Section 2. Repeal. Chapter 23, Article 3, Section 7 (c) of Ordinance No. 5823, Revised Ordinances of the City of Salina, Saline County, Kansas, for 1948, as amended, i is hereby repealed. Section 3. Effective date. This ordinance shall take effect and be in force from and after its publication once inthe official city paper.
