AN ORDINANCE ratifying and confirming a contract with Br & Brown, Inc., for the can- struction of certain paving and grading improvement s on�reets in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance andsale of bonds. BE IT CRDAINED By the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the Brown & Brown Construction Co., Inc., hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on June 21, 1954, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City by its Mayor on June 28, 1954, for the construction of certain public improvements in the City of Salina, Kansas to -wit: of Paving and grading/Front Street from the north line of Iron Avenue to the South line of Ash Street, as provided by Ordinance Number 5859. Paving and grading of Twelfth Street from the north line of Charles Street to the north line of Crawford Avenue, as provided by Ordinance Number 5859. Paving and grading of Wilson Street from the East line of Front Street to the West line of Kenison Road, as provided by Ordinance Number 5859. at and for the unit price for said work contained in said proposal, mhie4 proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said Improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk, which estimates are hereby referred to and made a part of this Ordi- nance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file In the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of whichare hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the 4yor and attested by the City Clerk be issued from time to time as the work progresses inthe manner and form as required by law, the total amount thereof not to exceed the contract price of $82,791.50, for such work, such notes to bear interest not to exceed 42 per cent per annum and to mature not later than December 1, 1954, and to be issued in such amounts and at such time as money for the payment of the cost of such notes being issued to said contractor and to be redeemed add cancelled at the time that permanent bonds are issued in lieu thereof.
