AN ORDINANCE relating to and apportioning and levying special assessments on certain
lots and pieces of ground in the City of Salina, Kansas, to pay the cost of paving
and grading Eighth Street from the north line of Grand Avenue to the south line of
Woodland Avenue; for the paving and grading of College Avenue from the south line
of Prescott to the north line of Morrison Avenue; Por the paving and grading of
Ellsworth Street from the west line of Highland Circle to the east line of Pershing
Street; for the paving of Phillips Street from the north line of Prescott Avenue
to the south line of Charles Street; for the paving and grading of Roach Street
from the north line of McAdams Road south to the south line of Martin Avenue; for
the curbing, guttering, paving and grading of Roach Street from the south line of
Minneapolis Avenue to the north line of Beloit Street; for the paving and grading
Of Wilson Street from the west line of Kenison Road to the east line of Sunrise
Drive; for the paving and grading of Wilson Street from the east line of Roach Street
to the west line of Sunrise Drive; and for the curbing, guttering and grading of
Third Street from the north line of Harsh Avenue to the south line of on anpayment of suHamilton
Avenue, and relating to and providing for the collection

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
j Section 1. For the purpose of paying for that part of the cost of improve-
ments in certain portions of certain streets as hereinafter set forth in the
following sections of this ordinance which is chargeable to the private property
in the assessment districts for each of such improvements, respectively, as set
forth in the following sections of this ordinance with respect to each of such
improvements there are hereby levied and assessed on the property liable therefor,
being all the lots and pieces of ground lying on either side of said street so

improved, respectively, to the middle of the block for the distance improved, with
respect to the improvements mentioned in Sections 2 3 4 6
> 5, 7, 8, 9, and to

of this ordinance, according to the appraised value of such lots and pieces of
ground with respect to each such improvement, without regard to the buildings or
i
improvements thereon, special assessments covering the cost of such work and improve-
ments, said special assessments being based on the special valuation and appraise -
I
ment of said lots andieces of
P ground heretofore made by three disinterested
appraisers appointed by the Board of Commissioners of the City of Salina, Kansas,
with respect to each such improvement, which said appraisements are hereby referred
to and made parts of this ordinance, and the several amounts so levied, apportioned
and assessed against the lots and pieces of ground for each such improvements,
respectively, for the purpose aforesaid, are hereby found and determined to be the
amounts set forth in the following sections of this ordinance with respect to each
of said improvements.
Section 2. For that part of the cost of paving and grading Eighth Street from

the north line of Grand Avenue to the south line of Woodland Avenue, which is
chargeable against the private property within the district chargeable therefor,
and which cost is hereby determined to be $8,001.18, there is hereby � y levied,

Section U. Said Amounts so levied, apportioned and assessed as aforesaid
will be due and collectible in ten equal installments, the first becoming due
with the taxes levied for the year 1954, and one of said installments falling due
each and every year thereafter until all are paid and all to be collected with
interest as in this ordinance provided, PROVIDED, HOWEVER, that the owner of any
pieces of property liable for any such assessment may redeem his property from such
liability by paying into the City Treasury the entire amount chargeable against
the same, as in this ordinance provided, at any time within thirty days after the
publication of this ordinance and before the issuance of bonds of said city in
payment of the balance of the cost of said improvements, the property so paid on
i
shall not thereafter be liable for any further assessments for the cost of said
improvements nor for any part of said bonds.
Section 12. There is hereby leveid further and assessed against such lots
and pieces of ground described in this ordinance, interest at such rate per annum
i
t as shall be borne by the bonds hereafter to be issued for the payment of the
remaining unpaid cost of such improvements, to be hereafter determined and fixed
i
by ordinance when such bonds are issued, on all of said installments mentioned and
provided for in this ordinance, from the date of the bonds which may be issued at
the end of thirty days as specified in the preceding sections hereof, as by law
provided, to the time of the collection of the installment as provided by law, which
i
said interest shall be collected annually at the same time and in the same manner
as said installments are collected and after the taking effect of this ordinance
and the fixing of the said interest rate when such bonds are authorized and issued,
it shall be the duty of the City Clerk of said City to annually at the same time
other taxes are certified and until all of said assessments so apportioned and
levied have been certified to the County Clerk of Saline County, Kansas, a full

list of all property liable to assessment and taxation for such work and improvement,

except such property on which the special assessments aforesaid have been paid
in full as hereinbefore provided, together with the respective amounts due on each
of said lots and pieces of ground which amounts shall include the annual install-
ments of such special assessments together with the interest for one year at the
rate to be fixed as provided for in this ordinance, on all unpaid balances of such
assessments, and such amounts so certified as herein provided shall be placed
upon the tax roll by the County Clerk of Saline County, Kansas, and collected as
other taxes are collected.
Section 9. This ordinance shall take effect and be in force from and after
its publication once in the official city paper.
