AN ORDINANCE condemning certain land within the City of Salina, Kansas, for the use of said
city in the opening and extending of Ohio Street south to its intersection with the north'
line of Cloud Street; fixing a benefit district therefor, and providing for the payment of
the costs thereof.
i0t i , the governing body of the ;,;ity of Salina, Kansas, on the 10th day of P -lay, 1954,
found it necessary to appropriate certain private property located in the City of Salina,
Kansas, for the use of said city in the opening and extending of Ohio Street south from
the north liee of Minneapolis Avenue, exeepting two certain blocks portions of which have
heretofore been dedicated to the City of Salina, Kansas, for use as a street, to the
north line of Cloud Street, and directed the City Engineer of the City of Salina, Kansas,
to make a survey and description of the land so required;and,
AMPLAS, on the 12th day of May, 1954, a survey and description of the land so required
was duly filed with the City Clerk;
5A0, NOVI, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. The following described land is hereby condemned and appropriated for
the use of the City of Salina, Kansas, for the opening and extending of Ohio Street south
from the north line of i,iinneapolis Avenue to the .north line of Cloud Street, to -wit:
Tract No, 1. Beginning at a point at the intersection of the east
boundary of the Southeast Quarter (SE/4) of Section 24, Township 1)j,
Range 3 West of the 6th P.M. in Saline Country, Kansas, and the north
line of Jewell Avenue extended east, thence west a distance of 50
feet, thence south a distance of 1328.23 feet to the .north linecf
Cloud Avenue, thence east along the north line of ""'loud Avenue to the
said east boundary line of vection 24, Township 14, Range 3 west of the
6th P.14.1 thence .north along the said quarter section line a distance of
1 1328.23 feet to the point of beginning;
Tract No. 2. Beginning at a point at the intersection of the east
boundary of the Southeast Quarter (SE/4) of Section 24, Township 14,
Range 3 West of the 6th P.M., in Saline County, Kansas, and the north
line of Minneapolis Avenue, extended east, thence east a distance of
50 feet, thence south a distance of 1930.23 feet to the north line of
Cloud Avenue, thence west along the north line of '71oud Avenue to the
said east boundafy line of said Section 24, Township 14, Range 3 west
of the 6th P.11%, thence north alongthe said quarter section line a
distance of 1980.23 feet to the point of beginning.
Section 2. It is found that the owners of Blocks 2 and b., Replat, Claflin Addition

of a size equal to that sought to be condemned herein, and that the said Blocks 2 and 4
should, therefore, not be included in the benefit district for thecondemnation herein
contemplated. It is found further that the following described property within the city
limits of the City of Salina, Kansas, will be specially benefited by reason of the
acquisition of said land..

the east boundary of Ohio Street, thence east a distance of 200 feet, thence south a
distance of 1,980.23 feet to the north line of Cloud Street, thence west a distance of
200 feet, to the east boundary of ohio Street extended, thence north along the east
boundary of Ohio Street extended, a distance of 1,980.23 feet to the point of beginning.
2. All of lots 7, 8, 9, 10, 11 and 12, all in Block 4, Replat, Claflin Add.itwn to
the Grounds of Kansas Wesleyan University, Salina, Kansas;
3. Beginning at a point which is the intersection of the south line of Jewell Avenue

and the west line of Ohio Street extended, thence west a distance of 200.0 feet, thence

said west line of Ohio Street extended, a distanceof 1,283.23 feet to the point of
beginning;
and that the said land shall be known as the benefit district.
Section 3. That C. L. Clark, City Attorney, is hereby ordered to forthwith
prepare and present in the name of the Board of Commissioners of the City of Salina,
Kansas, a written application to the Judge of the District Court of Saline County,
Kansas, praying for an order of appointment of commissioners to make appraisement and
assessment of damages arising from the appropriation of said real estate described in
Section 1 hereof and do and perform all things in and about procuring and recording
said order of appointment required by law.
Section 4. That for the payment of the cost thereof, the Board of Commissioners
shall issue Improvement Bonds of the City of Salina, Kansas, in an amount not to exceed
the total cost of acquiring sdd land herein condemned, except as herein provided, to be
payable in ten (10) approximately equal annual installments to bear interest at not to
exceed five per cent per annum from the date of such bonds and forthe purpose of paying
such bonds and interest as they severally mature, the Board of Commissioners shall:
Number 1. Apportion and assess against the lots and pieces of ground
within the benefit district, special assessments covering such portion of the cost of
such land so acquired as shall be chargeable to said benefit district, such assessment
and apportionment ordinance shall contain the total amount of tax apportioned to such
tract, piece or parcel of land within such taxing district andshall state the number of
annual installments in which such tax is to be collected; and thereafter the City Clerk'
shall annually, at the same time that other taxes are certified, certify to the County
Clerk of Saline County, Kansas, a fall list of all property liable for such work and
improvements, together with the respective numbered amounts clue on each of said tracts',
pieces or parcels of land, which amounts shall include the annual installments and
interest on all unpaid balances for one year at the rate of not to exceed five per cent
per annum., on such amounts so certified, which shall be collectdd as other taxes are
collected.
Number 2. Annually levy a tax upon all real and personal property in the
City of Salina in an amount sufficient to pay the annual installment of principal and
interest on that portion of the cost of such land so acquired as shall be chargeable to
the city at large; and providing the issue of such bonds, temporary notes shall be
issued according to law, topay the cost of acquiring such land.
Section 5 This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
