AN ORDINANCE condemning certain lands within the City of Salina, Kansas, for the use of
said city in opening and extending Franklin Avenue between the east boundary of Sunset
Manor Addition to the City of Salina and the west boundary of Southern Heilghts Addition to
the City of Salina; fixing a benefit district therefor, and providing for the payment of
the costs thereof.
WHKREAS, the governing body of the City of Salina, Kansas, on the 3rd day of May, 1954,
found it necessary to appropriate certain private property located in the City of Salina,
Kansas, for the use of said City in the opening and extending of Franklin Avenue between
the east boundary of Sundet Manor Addition to the City of Salina and the west boundary of
Southern Heights Addition to the City of Salina and direct that the City Engineer of the
City of Salina, Kansas,make a survey and description of the land so required; and
WHEREAS, on the 5th day of May, 1954, a survey and description of the land so required was
duly filed with the City Clerk;
SO, NOW, THEREFLM, BE IT ORDAINED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. The following described land is hereby condemned and appropriated for
the use of the City of Salina, Kansas, for the opening and extending of Franklin Avenue
between the east boundary of Sunset Manor Addition to the City of Salina, Kansas, and the
west boundary of Southern Heights Addition to the City of Salina, Kansas, to -wit:
j Part of the North half (N/2) of Section Twenty-three (23),
Township Fourteen (14), Range Three (3) West of the 6th
P.M. in Saline County,. -Kansas, described as: Beginning
at a pdnt which is the southeast corner of Lot 1, Block
2, in Sunset Manor Addition to the City of Salina, Kansas,
thence east a distance of 216 feet to the southwest corner
of Lot 81 Block 15, Southern Heights Addition to the City
of Salina, Kansas, thence south a distance of 60 feet to the
northwest corner of Lot 1, Block 16, Southern Heights Addition
to the City of Salina, Kansas, thence west a distance of 216
feet to the northeast corner of Lot 19, Block 1, Sunset Manor
Addition to the City of Salina, Kansas, thence north a distance
of 60 feet to the place of beginning;
Section 2. It is found that the following described property within the city limits
of Salina, Kansas, will be specially benefited by reason of the acquisition of said land:
Benefit District:
Lots 15, 16, 17, 18, and 19 in Block 1; Lots 8, 91 10,
11, 12, 13, 14, 15, 16, 17 and 18 in Block 3; Lots 17,
18, 19, 20, 21, 22, 23, 24, 25, 26 and 27 in Block 5;
Lots 11 2, 3, 4, and 5 in Block 2; Lots 15, 16, 17,
18, 19, 20, and 21 and Lots 1, 2, 3, and 4 in Block 4;
Lots 25, 26, 27, 28, 29, 30 and 31 and Lots 1, 2, 3
and 4 in Block 6, all in Sunset Manor Addition to
the City of Salina, Saline County, Kansas, and the
following additional property in the North Half (N/2)
of Section 23, Township 14, Range 3 West of the 6th
P.M. in Saline County, Kansas, described as follows:
Beginning at a point which is the southeast corner
of Lot 1 in Block 2 in Sunset Manor Addition to the
City of Salina, Kansas, thence north a distance of
330 feet, thence east a distance of 150 feet, thence
south a distance of 330 feet, thence west a distance
of 150 feet to the point of beginning; and in additnn
thereto, the following described property in the
North Half (N/2) of Section 23, Township 14, Range 3
West of the 6th P.M. in Saline County, Kansas, des-
cribed as follows:
Beginning at a point which is the northeast corner
of Lot 19, Block 1, Sunset Manor Addition to the
City of Salina, Saline County, Kansas, thence south
a distance of 330 feet, thence east a distance of
150 feet, thence north a distance of 330 feet, thence
west a distance of 150 feet to the place of beginning;

and that said land shall be known as the benefit district.

Section 3. That C. L. Clark, city attorney, is hereby ordered to forthwith prepare

and present in the name of the Board of Commissioners of the City of Salina, Kansas, a
written application to the Judge of the District Court of Saline County, Kansas, praying
for an order of appointment of commissioners to make appraisement and assessment of
damages arising from the appropriation of said real estatedescribed in Section 1 hereof
and do and perform all things in and about procuring and recording of said order of
appointment required by law.
Section 4. That for the payment of the cost thereof, the Board of Commissioners
shall issue Improvement Bonds of the City of Salina, Kansas, in an amount not to exceed
the total cost of acquiring said land herein condemned, except as herein provided, to be
payable in ten (10) approximately equal annual installments to bear interest at not to
exceed five per cent per annum from the date ae such bonds and for the purpose of paying
such bonds and interest as they severally mature, the Board of Commissioners shall:
Number 1. Apportion and assess against the lots and pieces of ground within the
benefit district, special assessments covering such portion of the cost of such land so
acquired as shall be chargeable to said benefit district, such assessment and apportion-
ment ordinance shall contain the total amount of tax apportioned to such tract, piece or
parcel of land within such taxing district and shall state the number of annual install-
ments in which such tax is to be collected; and thereafter the City Clerk shall annually,
at the same time that other taxes are certified, certify to the county Clerk of Saline
County, Kansas, a full list of all property liable for such work and improvements, to-
gether with the respective numbered amounts due on each of said tracts, pieces or parcels
of land, which amounts shall include the annual installments and interest on all unpaid
balances for one year at the rate of not to exceed five per cent per annum, on such amounts
so certified, which shall be collected as other taxes are collected.
Number 2. Annually levy a tax upon all real and personal property in the City of
Salina in an amount sufficient to pay the annual installment of principal and interest on
that portion of the cost of such land so acquired as shall be chargeable to the City at
large; and providing the issue of such bonds, temporary notes shall be issued according to
law, to pay the cost of acquiring such land.
Section 5. This ordinance shall take effect and be in force from and after its
publication in the official city paper.
