ORDINANCE NUMBER 98-9892
AN ORDINANCE PROVIDING FOR THE VACATION OF PORTIONS OF
HE EXISTING DRAINAGE AND UTILITY EASEMENTS LOCATED ON LOTS 6 AND
BLOCK 1, RIFFEL ADDITION TO THE CITY OF SALINA, SALINE COUNTY,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on September 21, 1998, the governing body conducted a public
on the petition of Norman Riffel ("Petitioners") requesting vacation of portions of the
and utility easements located on Lots 6 and 7, Block 1, Riffel Addition to the City of
Saline County, Kansas, more particularly described as follows:
that:
Lot 7 Utility Easement: The west ten feet (10.00') of Lot Seven (7), Block
One (1), Riffel Addition to the City of Salina, Saline County, Kansas. The
above-described easement contains 3005 square feet more or less.
Lot 6 Drainage and Utility Easement: A tract of land located in Lot Six
(6), Block (1), Riffel Addition to the City of Salina, Saline County,
Kansas, described as follows:
Commencing at the northeast corner of said Lot Six (6), thence on an
assumed bearing of S 00°05'26" W, along the east line of said Lot Six (6),
a distance of 156.67 feet to the point of beginning;
• Thence S 00°05'26" W, along the east line of said Lot Six (6) a
distance of 144.20 feet, to the southwest corner of said Lot Six (6);
• Thence N 89°54'34" W, along the south line of said Lot Six (6), a
distance of 90.15 feet;
• Thence N 27°33'07" E, a distance of 140.68 feet;
• Thence N 52°38'10" E, a distance of 31.84 feet, to the point of
beginning.
Said tract of land contains 7,449.50 square feet, more or less.
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the easement.
(c) Injustice to the Petitioner vacation of the easement should be granted.
Section 3. That the easement is hereby vacated and shall revert to the owners of
6 and 7, Block 1, Riffel Addition to the City of Salina, Saline County, Kansas.
Section 4. That this ordinance shall be in full force and effect from and after its
ion and publication once in the official city newspaper.
