the district which such sewer is to be constructed and shall on or before the same date
prepare and submit to the Board of Commissioners a detailed estimate under oath of the
cost thereof. That thereafter the City Clerk shall advertise for three consecutive days
in the official city paper for sealed proposals forthe building and construction of such
sewer according to such plans and specifications, which proposals shall be filed with
the City Clerk on or before the time fixed in such notice, at which time the Board of
Commissioners may let a contract for the building and construction of such sewer to the
lowest and best responsible bidder or bidders therefore, if there be any whose bids do
not ercccd the estimated cost thereof, but said Board shall reserve the right to reject
AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the City
of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 300 and providing
for the construction of a lateral sanitary sewer in said Lateral Sanitary Seger District
Number 300, so created, and providing for the payment of the cost thereof and for the
levying of special assessments against the property in said dstrict for the payment of
the cost of such construction and for the issuing of bonds to pay the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 300. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall
be and it is hereby designated as Lateral Sanitary Sewer District Number 300 and which
district shall include all the following described property in th-- City of Salina, Kansas;
to -wit:
Benefit District: All of Block one except Lots a_,2,3,4,5,6,7, and 8
of Eisenhower Addition.
A tract of land on the west side of U.S. 81 By -Pass described as follows:
Beginning at a point on the west line of U.S. 81 By -Pass which point is the
northeast corner of Block 1, Eisenhower addition thence north 653.70 feet;
thence west 165 feet; thence south 653.70; thence east 165 feet to the point
of beginning.
A tract of land on the west side of U.S. 81 By -Pass described as follows:
Beginning at apoint on the west line of U.S. 81 By -Pass which point is 683.70
feet north of the northeast corner of Block 1, Eisenhower Addition; thence
f north along west right-of-way of U.S. 81 By -Pass; thence west 165 feet;
thence south 200 feet thence east 165 feet to the point of. beginning.
Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P.
lateral sanitary sewer with all necessary connection, manholes; flushing tanks and other

appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer
District Number 300 as created by Section 1 of this ordinance along the following course,''
to -wit:
An 8 inch clay pipe sewer beginning at an existing manhole which is in the
center line of Crawford Avenue and 10 feet east of the west line of U.S. 81
By -Pass; thence north on a line 10 feet east and parallel to the west line
of U.S. 81 By -Pass 1441.70 where a manhole will be constructed which will be
terminus of Lateral Number 300.
Section 3• That the City Engineer shall on or before i�a.rch 15, ,19cf
prepare and file in the office of the City Clerk, plans and specifications for the

construction of the lateral sanitary sewer provided for in the preceding sections of
this ordinance which shall be of the proper character to serve the property lying within
the district which such sewer is to be constructed and shall on or before the same date
prepare and submit to the Board of Commissioners a detailed estimate under oath of the
cost thereof. That thereafter the City Clerk shall advertise for three consecutive days
in the official city paper for sealed proposals forthe building and construction of such
sewer according to such plans and specifications, which proposals shall be filed with
the City Clerk on or before the time fixed in such notice, at which time the Board of
Commissioners may let a contract for the building and construction of such sewer to the
lowest and best responsible bidder or bidders therefore, if there be any whose bids do
not ercccd the estimated cost thereof, but said Board shall reserve the right to reject
any or all such proposals, and if no bid shall be received within such estimate, the

Board of Commissioners shall have the power to do such work and make such improvements
within the estimated cost thereof as provided by law.
Section 4. That for the cost ofbuilding and constructing such sewer, special
assessments shall be made for the full cost thereof on all lots and pieces of land with-
in and for which such sewer shall be built, according to the appraised value thereof,
without regard to the buildings or improvements thereon.
Section 5. After the passage and publication of this ordinance, the Board of
Commissioners shall_ appoint three disinterested appraisers, who after having taken oath
to make a true and impartial appraiseraent of all lots and pieces of land liable to
taxation for the cost of such improvements, shall within fine days after having been
notified of their appointments proceed to appraise all of the lots and pieces of land
within such district liable to assessment and taxation as aforesaid, without regard to

improvements thereon, and after making such a.ppraisements, shall return,

to the Board of COMa--osioners of said city and said Board shall designate o time for a
special meeting of said Board for the purpose of hearing any complaints that may be
made as to the value of any lot or piece of land appraised as aforesaid, of which special;
session due notice shall be given in the official city paper, .at which special session
said Board may alter any valuation of any lot or piece of land,if, in their opinion, the
same has been appraised too high or too low.
Section 6. The special assessment herein provided for may be paid by the person
liable therefor in four approximately equal annual installments but the owner of any
property liable to such assessment may within thirty days from the date of determining

the amount assessed against the property, pay the same in full and hiv property shall not;
be liable for any assessments for the cost of such improvements, and bonds as hereinafter,
provided for shall be issued in the amount of the cost of such improvements remaining

unpaid at the end of the thirty days from the time such assessment is fixed.

Section 7. For the purpose of paying for the work and improvements in this
ordinance provided for, the Board of Commissioners may and are hereby authorized and
j directed to issue improvements bonds of the City of Salina, Kansas, in an amount not to
exceed the total cost of such improvement, and to run for a period of four years and be
payable in four approximately equal annual installments, together with interest not to
exceed five per cent per annum, which bonds shall be issued and payable according to
law; and for the purpose of paying the principal and interest on said bonds as they

severally become due and payable the Board of Commissioners shall apportion and assess
against the lots and pieces of land within the taxing district of suchimprovements,

special assessments covering the cost of such improvement and apportionment therein
i

contained shall hold good for all of the installments that are to be collected from the
specific property chargeable, with such improvements; such assessment and apportionment
ordinance shall contain the totalamount of tax apportioned to ,such tract, piece or
parcel of land within the taxing district and shall state the number of annual install-
ments in which such tax is to be collected; and thereafter the City Clerk shall annually,
at the same time that other taxes are certified, certify to the County Clerk of Saline
County, Kansas, a full list of all property liable for such work and improvements, to-
gether with the respective numbered amounts due on each of said tracts, pieces or parcels
of land, which amounts shall include the annual installments and interest on all unpaid
balances for one year at the rate of not to exceed five per cent per annum, on such
amounts so certified, which shall be collected as other taxes are collected.
Section 8. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
