ORDINANCE NUMBER 98-9890
AN ORDINANCE PLEDGING, PURSUANT TO K.S.A. 12-197, THE GENERAL
URPOSES PROPOSED FOR THE FUTURE USE OF THE REVENUE TO BE RECEIVED
ROM THE PROPOSED ADDITIONAL QUARTER PERCENT (1/4%) RETAILERS' SALES
AX TO BEGIN JANUARY 1, 1999 AND END JUNE 30, 2004.
WHEREAS, in response to a valid petition signed by the requisite number of electors,
the Governing Body has adopted Ordinance Number 98-9887 as required by K.S.A. 12-187 submitting
to the electors of the city of Salina in the November 3, 1998 general election a proposition on the
imposition of a retailers' sales tax (the "Sales Tax"), as follows:
"Shall the City of Salina, Kansas impose an additional quarter percent (1/4%) retailers'
sales tax beginning January 1, 1999 and ending June 30, 2004 with the proceeds to
purchase instructional technology and career/technical education equipment, services,
and training for U.S.D. #305?";
and
WHEREAS, K.S.A. 12-197 provides that the governing body of any city which has
adopted such an ordinance may adopt an ordinance in accordance with the provisions and procedural
requirements of K.S.A. 12-137 pledging the general purposes proposed for the future use of all or a
portion of the revenue to be received from such tax if the tax is approved by the voters; SO NOW,
THEREFORE
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. If the Sales Tax is approved by the voters, all of the revenues to be received
from the Sales Tax shall be used to purchase instructional technology and career/technical education
equipment, services, and training for U.S.D. #305.
Section 2. In accordance with K. SA. 12-137, upon adoption by a two-thirds (2/3) vote
of the members -elect of the governing body, this ordinance shall be published once each week for two
(2) consecutive weeks in the official city newspaper and shall be effective sixty (60) days after its final
publication, unless within sixty (60) days of its final publication a petition signed by a number of electors
of the city equal to not less than ten percent (10%) of the number of electors who voted at the last
preceding regular city election shall be filed with the county election officer of Saline county demanding
that such ordinance be submitted to a vote of the electors, in which case it shall not take effect until
submitted to a referendum and approved by a majority of the electors voting thereon.
