Section 2. Ceneral

ordinance shall be revocable at the will of the City :1'ommission.
Section 3. Application for permit. Any person desirin, 4 construct a drivei�ray
approach or recessed part.inr area across any curbinL, pa.rkinE, sideway:, or sidcti:alk
space, shall first make application to the City 'Engineer for a. permit therefor, Sa;d
application shall be in writin:� upon a form provided by the City, a.n_r' ,. adc available at
the office of the City En ;ineer. Such applicat:i.on shall. contain in:%ormation showing
type and estimated cost of construction, the dimensions of the proposed driveway approach
or recessed pari<:5_rag area, the location of said drive,. -;ay approach or recessed paring
arca by lot and block number, as ., ell as by street and house number, the location of the
driveuay approach or recessed parkin; area on the lot and such other information as may
be required by the Cite Engineer. The application shall be filed by the property owner
desiring to construct said driveway approach or by his -'uly aat"..,,ori.zed agent-..
Sect,=.on 1t. Issuance of Permit; Pond. Such permit shall be isaued by the City
ung-ineer if ho has determined that the applicant has complied with the terms of this
ordinance end such rules, regulations and specifications of the City En ineer as shall be
on file in his office and in the office of the City Clerk. The driveway approach or
recessed pa_rkinr area shall be completed ti•.itrin. (120 days) after the date of issuance of
such permit. Before a permit shall be issued by the City nLineer, the applicant must
deposit with the City '.lcrk a good and su !ficient bond runnin" in favor of the Cit;r of
Salina and conditioned that the applicant shall faithfully carry outal_l is required of
him by this ordinance, the saidrules, regulations and specificat-ions of the City Engineer

and the permit for which application is rude within a period of (120 days) from the datE>
of the issuance of the permit. After such permit has been issued the 'pond shall be for-
feited if the permit holder shall not have completed all of the work authori;-,ed by the
said permit in accordance with this ordinance and the said rules, regulations arc- speci-
fications of the City Engineer with _" a period of (120 days) frornl the date of t' -.c iss
ancc of the permit; �1.nd the City shall be authorized to restore the parcel of landinvolvcd
to the condition in ahich it c:isted prior to the commenccment of any work that ;as done
under the permit, includi_nL curbing and cuttcrin�; .There r-cessary, all at the e, -Tense of
the permit holder, applying thereon the proceeds of the said bond. If the work shah': be
completed in accordance with the porrrit, this ordinance and the said rules, re"ulations
and specifi cati ons of the "lit.y Enginecr ?,rithin a period of one '�undred "'wenty (12 o) days
from. the date of the issuance of the pormit, the bond shall be null and void. Such bond
shall be in an amount equal to half a -a -in t -.he value of the improvemen9:s, as shown on th,^
apl:licaticn for tl- permit and shall be prepared and e:�ccu.ted in accordance with the
provisions of Chapter 11, :..evised. Ordinances of the "'ity of Salina, 19V�, c,,cept that such
bond need not be approved by the City Attorney and 17ity :;ormii ssion, but must be approved
by the City Ln ineer.
Section [. Supervision; Specifications. All work done un cr a permit issued in
compliance .dth this ordinance shall be under the dirceti on and. supervision of the 1:ity
i nzineer, TIho is hereby authorized to make the necessary rules, regulations and specifi-
cations t�ith respect -to materials for and method of con.structio:n of such driveway ap-
proaches and recessed parking areas. Such rules, rezalations and specifications ^hall
be kept on file in the office of the City Engincer and the City :lerlc at all times. A
permit issued under the provisions of this ordinance ila:y be , _;� okcd by the City Engineer
at any time he is satisfied that the work is not being performed according to the pro-
visions hereof. The plans and specifications for ary such work are now on file in said
offices, are before the cormtissi.on and are hereby approved and adoptee?..
Section 6. Construction. In addition to the rules, reL�ul.ations and specifications
promulgated by the City Jn`i.neer with respect to drivew-,y approa.c. c,-., tl.c following:

constructed in a :Wanner that will in any way interfere with or obstruct the draina`;e of
the street, or in.terfcre with the use of the street for the purpose of travel.
(e) The owner and contractor shall_ protect the public from the injury and/or damaz c
durinE ti -e construction of driveway approaches and it is herein stipulated as an essential'
condition of the issuance of a permit that `he City of Salina, Kansas shall not be liable'
for damaCe which may arise from the prosecution of said work.
(f) The right angle distance between the face of the cxis--ink; curb and the face, of
tl, recessed curb shall be not less than nine (y) feet in all_ recessed. par'c5.n, areas
hereafter Constructed.

the flow line of the Butter to a point not less than four (Z.) inches balo,J the level of

Section 7. Idth and Location of Driveway Approaches and_".ccessed Parkin- Areas.
