WHE EA.S, pursuant to proceedings duly had according to law, contracts have been lst and performed for the construction of the following street improvements in the City of Salina, Kansas, to -wit: Paving and grading of alley first east of Fifth Street from the North line of Iron Avenue, North 207 feet more or less to the existing brick pavement, as provided by Resolution Number 1259 and Ordinance Number5636. Paving and grading of Sheridan Street from the northl:ine of Venango Street to the south line of Franklin Street, as provided by Resolution Number 1258 and Ordinance Number 5635. Curbing, guttering, paving and grading of University Street from the west line of Clark Street to the east line of Broadway Boulevard, as provided by Resolution Number 1257 and Ordinance Number 5635. Paving and grading of Anderson Avenue from the west Line of Front Street to the west line of Third Street, as provided by Resolution Number 1287 and Ordinance Number 5688. Paving vr.th concrete the center parking in Ash Street from Oakdale Avenue to Penn Avenue; and paving with concrete the center parking in Ash Street from Penn Avenue to Columbia Avenue, as provided by Resolution Numb-— 1305 and Ordinance Number 5688. Paving with concrete the center parking in Ash Street from Kansas Avenue to -Des Moines Avenue, as provided by Resolution Number 1316 and Ordinance Number 5688. Curbing,utteri.ng, grading and paving of University Street from the Fast line of the Missouri Pacific Railroad right of -bray, West 29 feet more or less, to the east edge of ties on railroad track, as provided by Resolution Number 1329 and Ordinance Number 5726. .��EZhAS, the total cosi. of said curbing, guttering, paving and grading of said streets, which are to be paid by special assessments and to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering, grading and paving in said streets has been ascertained and has been hereby found. and determined to be the sum of )121)245-00 iyhich amrn::nt has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefor according to law provided for in the ordinance of the City of Salina, Kansas, relating thereto, duly passed and approved of which amount the sum of 4,6,21.4.09 has been duly paid by the property owners liable therefor, leaving a balance of. :;:115,010.91 for which bonds aro to be issued; and W �ES, bonds in the aggregate sur,, of '143, 940.89 are to be issued to pay the actual cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby authorized as a part of this ordinance and that for the purpose of providing; funds to pay the cost of improvements herein above referred to and described in the ordinances and resolutions hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of X113,940-°'9, which shall consist of One Hundred Forty -Three, numbered 1 to 143, inclusive all dated November 1, 1953, which shall bear interest at the rate of One and five-eighths per cent for bonds maturing during the years 1955 to 1958 inclusive and two per cent for bonds maturing during the years 1959 to 1964inclusive, Paving and grading of ioodland Avenue from the east line of Fourth Street to the east line of Third Street, as provided by Resolution Plumber 1338 and Ordinance Number 5726. Paving and grading of Republic Avenue from the east lane of Sunrise Drive to the west line of Roach Street, as provided by Resolution Number 1336 and Ordinance Number 5726. Paving and grading of Norton Street from the South line of. Idinneapoli.s Avenue to the South line of Ellsworth Avenue, as provided by Resolution Number 1323 and Ordinance Number 5726. Bonds numbered 31 to 45 for $1,000.00 each, due August 1, 1957. Bonds numbered 46 to 59 for x;1,000.00 each, due August 1, 1958. Bonds numbered 60 to 73 for "1,CCC.CC each, due August 1, 1959. Bonds numbered 74 to 87 for 141,000.00 each, due August 1, 1960. Bonds numbered 88 to 101, for 01,000.00 each., due August 1, 1961. Bonds numbered 102 to 115 for $1,000.00 each., due ,August 1, 1962. Bonds numbered. 116 to 129 for $1,000.00 each, due August 1, 1963. Bonds numbered 130 to 113 for $1,000.00 each, due August 1, 1964. Section 2. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and corporate seal of the city shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which couponsshall be in the form provided by the law and shall bear the printed or lithographed facsimile signature of the Mayor and City Clerk of said city andsaid bonds and interest coupons shall be registered in the office of the City Clerk and in the office of the Auditor of State, as required by law. Section 3. Said bonds shall be designated as Series P-161 and shall be in the form and shall containrecitals substantially as follows, to - wit: so 7 S., T, UNITED STATES OF AMERICA State of Kansas COUNTY OF SALINE CITY OF SALINA No. INTERVAL T1 PROVEI ENT BONDS Series P-161 KNCRH ALL PEN BY THESE PRESENTS, That the City of Salina in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to the bearer the sum of DOLLARS in lawful money of the United States of America, on the first day of Mugu - 19 with interest hereon from the date hereof. at the rate of per cent per annum payable ugust 1, 1954, and thereafter semi-annually on the first days of February and August each year on presentation and surrender of the interest coupons hereto affixed as said coupons become severally due, both principal and interest of this bond being payable at the office of the State Treasurer of tre State of Kansas, in the City of Topeka, Kansas. And said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, creel _t and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 143 bonds of like date and tenor,£excepting denominations, interest rate and maturity, aggregating the principal sum of 414,910.89, issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing, curbing, guttering, paving and grading improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-128, 12-601 to 12-608 and 13-1011 and 13-1011a, all of the General Statutes of 4ansas, 1949, and amendments there- to, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. and it is hereby declared and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuanceof this bond have been properly done and perfor med and do e,d.st in due and regular forrr,,. and manner as required by laws and the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any con- stitutional or statutory limitation.
