AN ORD.LANCE providing for the establishtnont of rate- for taxicab service within the
City of Salina, providing for the reSulation and control of taxicab operations in said
city, al_. supplemental to e..istinC ordinances relating to taxicab operations in said
city, and providing for the amendment of Sections 13-1301, 13-1303, 13-1319, 1? -1330,
�_3-13%,0, 13-1342, and Section 13-1326, as amended, all of the Revised Ordinances of the
City of Salina, 1948, and providing for the repeal of said Sections 13-1301, 13-1303,
13-1319, 13-1330, 13-1310 and 13-13112, and for the repeal of Sections 13-1327, 13-1329,
13-13421 13-1344 and 13-1326, as amended, all of said .revised ordinance and pro -riding
for a penalty for the violations of the new sections thereof,.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section: (1) That Section 13-1301 of the Revised Ordinances of the City of Salina,
Kansas, 1948, be and it is hereby amended to read as follows:
"13-1_301. DEFINITIOP S. '�,1henever used in this article, the following terms shall
be .respectively defined as follows: (a) The word "street" shall mean and include
every public street, alley, avenue, road, highway, thoroughfare or public place in the
City of Salina, (b) The tiword"taxicab" as used herein shall include every and all
motor vehicles carrying passengers for hire for which a charge is made end for :which
public patronage is solicited, provided, however, that motor buses operating under a
franchise from the city or operating under authority and jurisdiction of the State
Corporation Commission shall not be termed tw,-icabs within the meaning hereof. (c)
"Person" and/or "persons" shall mean and include any person, firm, association, co-
partnership or corporation. (d) Taximeter: A mechanical device affixed to taxicabs
and designated to measure the distance driven and calculate the charge therefor, w1nich
is so installed that the figures or fares as stamped by the machine may be given to the
passenger as a receipt. Said term shall be deemed to include: mechanism for t} -,e accurate
measurement of time and distance and that the timing device shall correctly tabulate
and calculate the charge for waiting time. (e) Use of any word in the singular shall
include plural and use of plural shall include singular."
Section 2. That Section 13-1303, Revised Ordinances o' the City of Salina, 191;.8,
shall be and it is hereby amended to read as follows, to -wit:
"13-1303. APPLICATION: TITLE CERTIFICATE. Any person desiring to secure a
license for the operation of a. taxicab within the City of Salina shall file .with the
City Clerk a written application containing the following -i-nformation: (a) the fall
name and address of the owner and operator, (b) make, motor and type of vehicle, (c)
seating capacity (including driver), (d) motor and serial rn;.mber and state license
number of vehicle, (e) principal place of business, office address and name, and
niLht and day telephone numbers, of the manager in charge of operation of such taxicab,
and if the owner or operator is a corporation, the name of officers and directors of
such corporation, and if a partnership, the name of all the partners, (f) name of
insurance carrier carrying:; the liability insurance on such t<..xicabs as required in this
j ordinance and the number and date of issuance and date of expiration of such policy,
and such other irformation,, statemenus and agroements as may be required on a prin:,cd
form furnished by the City Clerk for such purpose, and the character and type of
ta:;imeter. ThCl application shall be accompanied by the title: certificate issued by the
State of Kansas showing ownership of such vehicle, which certificate shall be left with
the City Clark ta'nile any license issued on such application is in effect. No license
,shall be issued for a taxicab unless the same is equipped with and accurate and. work-
able taximeter mechanism so as to measure distance of transportation and a clock
mechanism to measure passage of time.
Section 3. That Section 13-1319 of the Revised Ordinances of the City of Salina,
Kansas, 1948, be and it is hereby amended to read as follows:
"13-1319. REVOCATION: SUSPENSIOY OF DRIVERS LICiENSE. A drivers license shall be
revoked by the ChL-f of Police for any of the following" r(;asons:
(a) Upon conviction of violation of any federal or state law.
(b) For oparatin` any v„hicle chile drunk.
For (c rer 7_eavin.; the scene of an accident.
(d) For failure to make full report of an accident to the policedepartmcnt.
(e) For permitting any other person to use his license.
(f) For obliteratin_� or erasinf any official entry on ;-.is license id.enti.:"i_cation
card.
(g} Upon conviction o:C a third major traffic violation durinC any one license
year (A major traffic violation is hereby defined to be: (1) spacding,
(2) rec'.less drivin`-, (,) non -observance, of !J -1 -Its or signs, (b) drivinL
�fnile drunik, (5) irrmroper brat. s, ( ) making a left or U-turn where not
permitted, (7) driving on. - he .,ronL, side of the street.)
(h) For violation of or failure to comply with any proirlsion in Article 13 of
C'r_apter 1`1 of the Revised Ordinances of thr City of Sallna, Kansas, and the
amendments and supplements hereto.
A drivers license may be suspended. by the '.thief of Police for a period of not to exceed.
ninety (90) daysfor any of the followin€_ reasons:
(a) First and second offenses of any major traffic violation.
(b) Repeat ,A infractionsof minor traffic laws or rules.

Section That Section 13-132' of the Revised Orcin�:nces cf the City of aal i.p2,

13-132('. TAXICAB RATES. The rates of fare of taxicabs for conveying; persons
with the usi_i.al hand l.u,LaLe shall be as follows: For the First three-fcurths (3/4)
mile or portion thereof, 35¢• a.nd for each succeeding half rr:ile or env fraction thereof 10¢,
For.reachhpassenger dvone U.�S0 each, excepting children under one (l� year of age,
and for each minute of tiraitin,; time in w --,,cess of 3 minu-:,es, 5¢ per rninutc:.c�ien a
taxicab is e:)loyed at an :sourly rental, tine fare in lieu of the specific trip fare
prescribed as aforesaid shall be ;3.00 per hour and 5 for each minute in addit on to
any hour or hours.
Provided., however, that no charSe shall be ,lace for time on stops occasion -
e0 by the driver himself, or by reason of any breakdowns, or for ;rert:ature arr:'.val anon
a call, or for waiting time or delays occasioned 'ojr traffic controls or con.jcstion.

drivers license is revoked in any of the manners aforesaid or the taxicab shall not be
relicensed at any time -xi-thin a period of two (2) years from the effective date of said

Kansas, 1945, be and it is hereby amended to read as follows:
"13-13114. VIOLATIONS: k D OPERATORS. Except as otherwise specifically
provided for in Chapter 13 of Article l3o.f -the Revised Ordinances of the City of E.al_ina,
Kansas, 10,48, and as supplemented and amended, any person w'no ohall violate any of the
provisions of said article and as amended and supplemented, or who shall operate and
and drive in the "ity of Salina any taxicab without 'being liccn_sed so to do as provided
for in said article or after any such license has been suspended or revoked, or who
shall fail to comply with any of the requirements of said chapter and article, shall
upon conviction thereof be punished by a fine of not less than :10.00 and not e ceeding
4100.00, and shall stand committed to the"ity Jail until such fine is paid."
Section 7.1EPEAL. That Sections 13-1301, 13-13C3, 13-1319, 1? -1330, 13-1V[21
13-1327, 13-1329, 13-13.4 and 3-3-1326, as amended., all of the Revised Ordinances of
the City of Salina, 1948, be and they are each hereby repealed.
Section C,. EFFECTIVE DATE. That this ordinance shall. be and remain in full force
and effect from and after its publication once in the official city paper and December
31, 1953.
