5806 Award Utility ImpORDINANCE NUMBER 5506 < , =- - --—--�-_(Publ, shed irLfhP�aj_i_na --- --- AN ORDINANCE ratifying and confirming a contract with H. J. Taylor Construction Company for the construction of certain lateral sanitary sewer in the City of Salina, Kansas, heretofore designated as Lateral Sanitary Sewer District 297, and providing for the issuance of temporary notes to pay the cost thereof, pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the H. J. Taylor Construction Company, hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on August 31, 1953, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City by its mayor on September It[, 1953, for the construction of certain public improve- ments in the City of Salina, Kansas, to -wit: An 8 inch clay pipe sewer beginning at an existing sewer 75 feet south of an existing manholewhich is 130 feet north of the north property line of Republic Avenue and 110 feet west of the west property line of Seminole Avenue, thence south 110 feet where a manhole will be constructed; thence west with branch No. 1, 296 feet to a manhole which will be constructed, thence with branch 'Number 2 from the manhole that will be constructed 15 feet south of the center line of Republic Avenue and 110 feet west of the center line of Seminole Avenue, 385 feet east to a manhole which will be constructed, which will be the terminus of Lateral Number 297. at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the City Engineer on file in the office of the City Clerk, which estimate is hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City .Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract priceof 82,333.00 for such work, such notes to bear interest at not to exceed 42,= per cent per annum and to mature not later than December 1, 195, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contractor andto be redeemed. and cancelled at the time that Internal Imp.r.ovement Bonds are issued in lieu thereof. Section 4. That this ordinance shall take effect and be in full force from and after its publication once in the official city paper.
