5805 Levy AssessmentsORDINANCE NU1,113ER 5805 _ ==jPqb.lshedt=n -the _ 5_aUna_ J -I AN ORDINANCE relating to and apportioning and levying special assessments in the City of Salina, Kansas, on certain lots and pieces of ground to pay the cost of construction of lateral sanitary sewer in Lateral Sanitary Sewer District Number 293, and relating to and providing for the collection and payment of such assess- ments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of paying for the cost of building and constructing lateral sanitary sewer in Lateral Sanitary Sewer District Number 293, as authorized by the provisions of Ordinance Number 5739, the cost of which has been duly ascertained as shown by the City Engineer's Final Estimate of Cost, which has been duly approved by the Board of Commissioners, there are hereby levied and assessed on the property liable therefor, beim; all the lots and pieces of ground lying in the sewer district mentioned above as created by Ordinance Number 5739, according to the appraised value of such lots and pieces of ground without regard to the buildings or improvements thereon, special assessments covering the cost of such improvements constructed in said sewer district, said special assessments being based on the special valuation and appraisements made by three disinterested appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, whichsaid appraisement is hereby referred to and made a part of this ordinance, and the several amounts levied, and apportioned against the lots and pieces of ground in said sewer district for the purpose of paying for thecost of improvements constructed in such district being found and determined to be as set forth in the following sections of this ordinance. Section 2. That for the purpose of the payment of the cost of construction of Lateral Sanitary Sewer Number 293, an eight inch clay pipe sewer constructed in three branches, said branches designated CC -1, CC -2, and CC -3. Branch CC -1 is described as follows: Beginning at a manhole located in Country Club Road six feet east and seven feet north of the northeast corner of Lot 3 in Block three Country Club Heights Addition No 2, an addition to the City of Salina, Saline County Kansas, thence south 660 feet in the right-of-way first east of Block 3, Country Club Heights Addition No. 2, 6 feet east of the east line of said Block 3, to the centerline of Crestview Drive; thence west along the centerline of Crestview Drive 200 Feet to a manhole to be constructed, Thence south along the centerline of utility easement between Lots 2 and 3 Block 4 in Country Club Heights Addition No. 2, 200 feet; thence along the centerline of utility easment along the south of Lot 2 in said Block 4, 100 feet; thence southwest along the centerline of utility easment along the east line of Block 4, 410 feet to a manhole to be constructed. Beginning also said manhole to be constructed in the center line of Crestview Drive, as aforesaid thence north along the centerline of north south utility easment in said Block 3, 470 feet to the centerline of the northermost west utility easment in said Block 3 to a manhole to be constructed, thence west along the centerline of said northermost east west F� 1 utility easment in said Block 3, 170 feet to the centerline of Hilldale Road, to a manhole to be constructed, thence southwestern along the centerline of Hilldale Road., 970 feet to a manhole to be constructed, being the terminus of branch CC -1. Branch CC -2 is described as follows: Beginning at said manhole to be constructed in the centerline of Hilldale Road, 170 feetsouth o f the south line of Country Club Road, thence west along the centerline of east west utility easment in Block 1 Country Club Heights Addition No. 2, 200 feet to a manhole to be constructed, thence west along the centerline said east west utility easment to a point in Overhill Road 6 feet east of and 5 feet south of the southeast corner of Lot 13 Block 6 in Country Club Heights Addition. Beginning also at said manhole to be constructed in said east west utility easment in Block 1, Country Club Heights Addition No. 2, thence south along the centerline of north south utility easment in said B1®ck 1 to the centerline of Crestview Drive to a manhole to be constructed, thence south along the centerline of the north south utility easment in Block 21 Country Club Heights Addition No. 2, to a manhole to be constructed at the intersection of the centerline of said north south utility easment with the northline of Lot 10 in said Block 21 being the terminus of Branch CC -21 Branch CC -3 is described as follows: Beginning at manhole in the centerline of Crestview Drive, 25 feet north of the northwest corner of Lot 4 Block 2, Couritry Club Heights Addition No. 21 thence west 180 feet to the centerline of Overhill Road to a manhole to be constructed thence southwestern along the centerline of Overhill Road 148 feet to a manhole to be there constructed and also commencing at the manhole to be constructed in Overhill Road, as aforesaid, thence northerly in the centerline of said road to a point 175 feet north of said manhole, being the terminus of Branch CC -3. Said amounts levied, apportioned and assessed as aforesaid shall be due and collectible in four equal installments, the first becoming due with the taxes levied for the year 1954, and one of said installments falling due each and every year thereafter until all are paid, all to be collected with interest as in this ordinance provided, provided however, that theowner of any piece of property liable for any such assessment may redeem his property from such liability by paying into the City treasury the entire amount chargeable against the same as in this ordinance designated at any time within thirty days after the publication of this ordinance, and before the issuance of the bonds of said city in payment of the cost of said improvements, and his property so paid, on shall not thereafter be liable for any further assessment for the cost of said improvements nor for any part of said bonds. Section 4. There is herdby levied and assessed against such lots and pieces of ground described in this ordinance, interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, such rate to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinance, from the date of the bonds which may beissued at the end of thirty days, as specified in the preceding section hereof as by law provided, to the time of collection of the last installment as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installment as collected, and after the taking effect of this ordinance and the fixing of the interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk and of said city to annually at the same time other taxes are certified, to certify to the County Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such work and improvements, except such property onwhich the special assessment aforesaid have been paid in full as herein before provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with COUNTRY CLUB HEIGHTS ADDITION # 2 Lot 4 --Block 4 - - - - - - - - - - - 277.25 Lot s-Block4----------- 290.05 Lot 6 -Block 4----------- 290.05 Lot 7-Block4----------- 290.05 Lot 8-Block4----------- 290.05 Lot 9-Block4----------- 290.05 lot 10Block4----------- 319.90 TOTAL 17581.87 Section 3. Section 5. This ordinance shall be in Effect and force from and after its publication once in the official city paper.
