V 1998) ORDINANCE NUMBER 98-9884 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE MBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE NING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING R THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND ESCRIBING THE PROPER USES THEREOF. ! WHEREAS, all conditions precedent for the amendment of the Zoning District Map, --i he rezoning of certain property therein, hereinafter described has been timely complied with, SO OW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -301, PLANNED SHOPPING ENTER DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted d published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, e and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lots 1 and 2, Block 1, Replat of the Wal-Mart Subdivision and the First Bank Addition to the City of Salina, Saline County, Kansas. hall become a part of an amended DISTRICT "PC -3", PLANNED SHOPPING CENTER Section 2. CONDITIONS OF APPROVAL. The use of said described property hall be subject to all the conditions, restrictions and limitations as made and provided for in â–ºrdinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "PC- ", PLANNED SHOPPING CENTER DISTRICT regulations, subject to the following conditions nd limitations: Development of the site shall be in accordance with the amended site development plan, including plans for the relocated detention pond and additional landscaping incorporated herein by reference. 2. Construction plans for the new drainage detention pond shall be approved prior to the issuance of a building permit for the building expansion. Detention pond facilities shall be completed and a maintenance agreement executed prior to occupancy of the building addition. 3. All landscaping, sidewalk, circulation, parking, utility and other improvements shown on the amended site development plan shall be completed prior to occupancy of the building expansion and shall be the responsibility of the applicant. 4. A site development plan shall be approved for any additional development on the West One Hundred and Fifty (150) feet of Lot 1 prior to issuance of a building permit. Section 3. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed, except that the conditions and limitations contained in Ordinance number 89-9318 shall remain in effect. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
