99-9916 Zone Dow Add Rplt(Published in The Salina Journal March�, 1999) ORDINANCE NUMBER 99-9916 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF THE COMPREHENSIVE PLAN OF THE CITY OF SALINA AND ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. COMPREHENSIVE PLAN AMENDMENT. That the Comprehensive Plan shall be amended to change the designation of the following described property from High Density Residential to Commercial Office. The West Ninety (90) feet of the North Thirty (30) feet of Lots One (1) and Two (2), H & H Addition Replat of the South Half (SI/2) of Lot Two (2), Block Ten (10) of Replat of Block One (1), Lots One (1) through EEiigghht (8), Dow Addition to the City of Salina, Saline County, Kansas The West Ninety (90) feet of the North One Hundred Fifty-four and Twenty-four Hundredths (154.24) feet of Lot Two (2), Block Ten (10) in the Replat of Block One (1), Lots One (1) through Eight (8), Dow Addition to the City of Salina, Saline County, Kansas. Section 2. AMENDMENT. DISTRICT "PC -1", PLANNED RESTRICTED BUSINESS DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be prezoned as follows, to -wit: The West Ninety (90) feet of the North Thirty (30) feet of Lots One (1) and Two (2), H & H Addition Replat of the South Half (SI/2) of Lot Two (2), Block Ten (10) of Replat of Block One (1), Lots One (1) through EANghht (8), Dow Addition to the City of Salina, Saline County, Kansas The West Ninety (90) feet of the North One Hundred Fifty-four and Twenty-four Hundredths (154.24) feet of Lot Two (2), Block Ten (10) in the Replat of Block One (1), Lots One (1) through Eight (8), Dow Addition to the City of Salina, Saline County, Kansas. shall become a part of DISTRICT "PC -1", PLANNED RESTRICTED BUSINESS DISTRICT. Section 3. CONDITIONS OF APPROVAL. The use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the T- I"', ', RESTRICTED BUSINESS DISTRICT regulations and development of the property shall also be subject to the following conditions, to wit: 1. Development of the site shall substantially conform to the approved site development plan and drainage plans on file with the Zoning Administrator. 2. Any parking lot lighting shall be cast downward and shaded so as to be directed away from surrounding residential property. 3. The trees in the existing hedgerow east of the driveway serving the expanded parking area shall not be removed as part of this parking lot project or if they are removed a comparable number of trees from the City's recommended tree list shall be planted in their place. Section 4. That all prior ordinances in conflict herewith as they relate to the above described real estate are hereby repealed. Section 5.
