ORDINANCE NUMBER 99-9913
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF
THE PUBLIC RIGHT-OF-WAY ALONG THE EAST SIDE OF NORTH TENTH STREET
FROM LINCOLN AVENUE TO NORTH STREET IN THE DEPOT ADDITION TO THE
CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on January 11, February 1, and February 8, 1999 the governing body
conducted public hearings on the petition of Doug Bradley ("Petitioner") requesting vacation of a
portion of the right-of-way along North Tenth Street, between Lincoln Avenue and North Street in
the Depot Addition to the City of Salina, Saline County, Kansas, more particularly described as
follows:
hearing that:
The west five (5) feet of the east fifteen (15) feet of the eighty (80)
foot right-of-way of Tenth Street from the north line of North Street
to the south line of Lincoln Avenue and being adjacent to the west
side of Block Five (5) of Depot Addition, is hereby vacated. (The
east ten (10) feet of said right-of-way having been previously vacated
by Ordinance Number 5447 on January 23,1950.)
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by
law.
(b) No private rights will be injured or endangered by vacation of the
right-of-way.
(c) In justice to the Petitioner vacation of the right-of-way should be
granted.
Section 3. That the right-of-way is hereby vacated and shall revert to the owners of
Lots 22 through 34, Block 5, Depot Addition to the City of Salina, Saline County, Kansas.
Section 4. That this ordinance shall be in full force and effect from and after its
adoption and publication once in the official city newspaper.
