ORDINANCE NUMBER 99-9912
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF
THE PUBLIC RIGHT-OF-WAY ADJACENT TO SCHILLING ROAD AND SOUTH
NINTH STREET, ADJACENT TO RIFFEL ADDITION TO THE CITY OF SALINA,
SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on February 8, 1999, the governing body conducted a public hearing
on the petition of Norman D. Riffel ("Petitioner") requesting vacation of a part of the right-of-way
adjacent to Schilling Road and South Ninth Street, adjacent to Riffel Addition to the City of Salina,
Saline County, Kansas:
A tract of land located in the North Half (N'/2) of the Northeast Quarter
(NEI/4) of Section Two (2), Township Fifteen South (T15S), Range Three
West (R3 W) of the Sixth Principal Meridian in Saline County, Kansas,
more particularly described as follows:
Commencing at the Northeast corner of said Northeast Quarter (NE'/4);
- Thence West along the North line of said Northeast Quarter (NE'/4) on an
assumed bearing of North Eighty-nine degrees Thirty-seven minutes and
Zero seconds West (N89°37'00"W), a distance of Three Hundred Forty
and Twenty-eight Hundredths (340.28) feet;
- Thence South Zero degrees Twenty-three minutes and Zero seconds
West (S00°23'00"W), a distance of Forty-four and Zero Hundredths
(44.00) feet to the Point of Beginning;
- Thence continuing South Zero degrees Twenty-three minutes and Zero
seconds West (S00°23'00"W), a distance of Sixty-one and Zero
Hundredths (61.00) feet to the Northwest corner of Lot One (1), Block
Two (2), Riffel Addition;
- Thence South Eighty-nine degrees Thirty-seven minutes and Zero
seconds East (S89°37'00"E), a distance of One Hundred Eighteen and
Fifty-eight Hundredths (118.58) feet;
- Thence South Forty-six degrees Forty-nine minutes and Ten seconds East
(S46°49'10"E), a distance of Fifty-three and Ten Hundredths (53.10) feet;
- Thence South Zero degrees Zero minutes and Forty seconds West
(S00°00'40"W), a distance of Three Hundred Fifty-four and Sixty-five
Hundredths (354.65) feet;
- Thence South Fifteen degrees One minute and Ten seconds East
(S 15'0 I'10"E) a distance of Twenty-five and Nineteen Hundredths (25.19)
feet;
- Thence South Thirteen degrees Eighteen minutes and Eleven seconds
East (S 13 ° 18111 "E), a distance of Ninety-one and Thirty-nine Hundredths
(91.39) feet;
- Thence South Zero degrees Eight minutes and Thirty-nine seconds West
(S00°08'39"W), a distance of Three Hundred Forty-one and Twelve
Hundredths (341.12) feet to the Southeast corner of Lot Five (5), Block
Two (2), Riffel Addition;
- Thence South Eighty-nine degrees Fifty-four minutes and Thirty-four
seconds East (S89054'34"E), a distance of Fifty and Zero Hundredths
(50.00) feet;
- Thence North Zero degrees Eight minutes and Thirty-nine seconds East
(N00 ° 08'39"E), a distance of Eight Hundred Four and Forty Hundredths
(804.40) feet,
- Thence North Forty-six degrees Forty-nine minutes and Ten seconds
West (N46°49'10"W), a distance of One Hundred Forty-nine and Five
Hundredths (149.05) feet;
- Thence North Eighty-nine degrees Thirty-seven minutes and Zero
seconds West (N89°37'00"W), a distance of One Hundred Twenty-six and
Eighty-six Hundredths (126.86) feet back to the Point of Beginning.
The above described tract of land contains One and Forty-eight
Hundredths (1.48) acres, more or less.
The North Twenty (20) feet of the above described right-of-way to be vacated,
containing Six Hundredths (0.06) acres, more or less, will be retained as an easement by the City of
Salina.
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the right-of-way.
(c) Injustice to the Petitioner vacation of the right-of-way should be granted.
Section 3. That the right-of-way is hereby vacated and shall revert to the owners of
Reserve "A", and Lots 1, 2, 3 and 5, Block 2, Riffel Addition to the City of Salina, Saline County,
Kansas, provided however:
(a) The City retains a portion of the vacated right-of-way as a utility easement as
described above;
(b) Restricted access shall be retained along the vacated right-of-way line except at
the location of existing access points and as shown on the attached drawing.
Section 4. That this ordinance shall be in full force and effect from and after its
adoption and publication once in the official city newspaper.
