99-9908 Initiate Storm Sewer MaC.WN (Published in The Salina Journal February ,:r, 1999) ORDINANCE NUMBER 99-9908 AN ORDINANCE ORDERING AND PROVIDING FOR A MAIN STORM WATER SEWER AND INITIATING PROCEEDINGS FOR THE CONSTRUCTION OF SUCH MAIN STORM WATER SEWER WHEREAS, the Governing Body of the City of Salina, Kansas (the "City") is authorized pursuant to K. S. A. 13-1055a et seq. (The "Act") to order and provide for main storm water sewers for the purpose of carrying off storm water from the streets, avenues and alleys of the City; and WHEREAS, the governing Body of the City has determined that it is necessary to build and construct a main storm water sewer for the purpose of carrying off storm water from the intersection of Ninth Street and Claflin Avenue in the City (the "Project"); and WHEREAS, reports, estimates and plans have been compiled and furnished to the Governing Body of the City to provide them with sufficient information in order to enable them to commence proceedings for the construction of the Project; NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas as follows: Section 1. The Project is hereby declared to be a main storm water sewer in the City for purposes of the Act. The Project shall commence at the intersection of Ninth Street and Claflin Avenue and proceed in an easterly direction along Claflin Avenue to Quincy Street where it will discharge into the Second Street Slough. Section 2. Proceedings should be and hereby are initiated pursuant to the provisions of the Act for the purpose of proceeding with the Project. Section 3. The City Manager and other City staff are authorized to take all necessary actions to proceed with the Project. Section 4. The cost of the Project or portions thereof shall be paid by the City -at -large through the issuance of one or more series of general obligation bonds of the City as provided by the Act, and pending the issuance of said bonds, through the issuance of one or more series of temporary notes of the City. Section 5. The City expects to make capital expenditures on and after the date of adoption of this Ordinance in connection with the Project, and intends to reimburse itself for such expenditures with the proceeds of one or more series of general obligation bonds and temporary notes of the City in the estimated maximum principal amount of $600,000, the anticipated cost of the Project to be paid by the City. Section 6. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
