99-9907 Vac Leavenworth Add(Published in The Salina Journal Januaryaq , 1999) ORDINANCE NUMBER 99-9907 AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF HE PUBLIC RIGHT-OF-WAY ADJACENT TO THE WEST SIDE OF LOT 1, BLOCK 12 F THE LEAVENWORTH ADDITION TO THE CITY OF SALINA, SALINE COUNTY, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on January 11, 1999, the governing body conducted a public hearing the petition of Barry C. Bohn ("Petitioner") requesting vacation of a part of the Right -of -Way to the west side of Lot 1, Block 12 of the Leavenworth Addition to the City of Salina, aline County, Kansas, more particularly described as follows: Beginning at a point that is the Northwest corner of Lot 1, Block 12 in said Leavenworth Addition; - Thence West along the South right-of-way of University Place a distance of Twenty (20) feet; - Thence South a distance of One Hundred (100) feet; - Thence East a distance of Twenty (20) feet; - Thence North a distance of One Hundred (100) feet to the point of beginning. The above described Right -of -Way to be vacated contains Two Thousand (2,000) feet, more or less, and the North Seventy-five (75) feet shall be retained as a public utility nt for ingress and egress rights for the City of Salina, for the purpose of constructing, ig, repairing, replacing and maintaining a public sanitary sewer system in perpetuity. that: Section 2. That the governing body finds from the evidence presented at the public (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by vacation of the Right -of -Way. (c) Injustice to the Petitioner vacation of the Right -of -Way should be granted. Section 3. That the Right -of -Way is hereby vacated and shall revert to the owners of 1, Block 12, Leavenworth Addition to the City of Salina, Saline County, Kansas, provided (a) The City retains the North Seventy-five (75) feet of the vacated Right -of -Way as a utility easement; Section 4.
