99-9920 Annex Eastview Estates(Published in The Salina Journal XFrt l I (Q , 1999) ORDINANCE NUMBER 99-9920 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TRACT OF LAND, IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the following described tracts of land, to -wit: Tract A: A tract of land located in the North Half (N/2) of the Northwest Quarter (NW/4) of Section 31, Township 14 South, Range 2 West of the 61 P.M., Saline County, Kansas, described as follows: Commencing at the northwest corner of said Northwest Quarter (NW/4), thence on an assumed bearing of S 01'03'05" W, along the west line of said Northwest Quarter (NW/4), a distance of 647.73 feet, to the southwest corner of a tract of land as surveyed described in Saline County Register of Deeds Office, Deed Book 373, Page Number 379; thence S 89'4735" E, along the south line of said tract as surveyed described in the Saline County Register of Deeds Office, a distance of 551.65 feet, to the Southeast corner of said tract described in the Saline County Register of Deeds Office, said point being on the west line of the Eastview Estates Addition to the City of Salina, Saline County, Kansas; thence S 01'00'19" W, along the west line of said Eastview Estates Addition a distance of 676.79 feet to the southwest corner of said Eastview Estates Addition, said point being on the south line of said North Half (N/2); thence N 89°36'53" W, along said south line of said North Half (N/2) a distance of 552.17 feet, to the southwest corner of said North Half (N/2); thence N 01'03'05" E, along the west line of said Northwest Quarter, a distance of 676.56 feet, to the point of beginning. The above described tract of land contains 8.54 acres, more or less, and Tract B: A tract of land situated in the Northwest Quarter (NW/4) of Section 31, Township 14 South, Range 2 West, of the 6`r' P.M., Saline County, Kansas which is more particularly described as: Beginning at a point 561.23 feet south of the northwest corner of said Section 31; thence on an assumed bearing N 89°02'15" E a distance of 551.24 feet; thence S 00°00'00" W a distance of 86.92 feet; thence S 89°02'15" W a distance of 551.24 feet; thence N 00°00'00" E a distance of 86.92 feet along the west line of said Section 31 to the point of beginning. The above described tract contains 1.10 acres, more or less, and Tract (street right-of-way): A tract of land located in the Northeast Quarter (NE/4) of Section 36, Township 14 South, Range 3 West of the 61 P.M., Saline County, Kansas, more particularly described as follows: Beginning at the southeast corner of said Northeast Quarter (NE/4); thence north along the east line of said Northeast Quarter (NE/4) on an assumed bearing of N 00°24'55" E, a distance of 2442.76 feet to a point which is 200.00 feet south of the northeast corner of said Section 36; thence west 30.00 feet to a point on the west line of Ohio Street; thence S 00°24'55" W parallel with the east line of the Northeast Quarter (NE/4) of said Section 36, a distance of 2442.76 feet, more or less, to a point on the south line of said Northeast Quarter (NE/4); thence east along the south line of said Northeast Quarter (NE/4), a distance of 30.00 feet back to the point of beginning. The above described tract of land contains 1.68 acres, more or less, and C-11daiaasON Tract : A tract of land located in the South Half (S/2) of the North Half (N/2) of Section 31, Township 14 South, Range 2 West of the 6' P.M., Saline County, Kansas, more particularly described as follows: Beginning at the northwest corner of the South Half (S/2) of the North Half (N/2) of said Section 31; thence east along the north line of the South Half (S/2) of the North Half (N/2) of said Section 31 on an assumed bearing of N 89'44'34" E a distance of 2982.85 feet; thence S 00'15'26" E a distance of 220.00 feet; thence N 80°29'41" W a distance of 412.82 feet to a point that is 150.00 feet south of said north line; thence S 89°44'34" W parallel with said north line, a distance of 2577.77 feet to a point on the west line of the Northwest Quarter (NW/4) of said Section 31; thence N 00°24'55" E along said west line, a distance of 150.01 feet back to the point of beginning. The above described tract of land contains 10.60 acres, more or less, and Tract E: A tract of land located in the Northwest Quarter (NW/4) of Section 31, Township 14 South, Range 2 West of the 61 P.M., Saline County, Kansas, more particularly described as follows: Commencing at the northwest corner of said Northwest Quarter (NW/4); thence east along the north line of said Northwest Quarter (NW/4), on an assumed bearing of N 90°00'00" E, a distance of 2203.86 feet to the point of beginning; thence continuing N 90°00'00" E along said north line, a distance of 140.00 feet; thence S 00'27'17" W a distance of 170.00 feet; thence S 90°00'00" W parallel with the north line of said Northwest Quarter (NW/4), a distance of 140.00 feet; thence N 00'27'17" E a distance of 170.00 feet back to the point of beginning. The above described tract of land contains 0.546 acres, more or less. The above described tracts, meeting one or more of the classifications for annexation prescribed by K.S.A. 12-519 to 12-526, inclusive, are hereby annexed and made a part of the City of Salina, Kansas. Section 2. That Tracts A and B, described in Section 1 above, shall be zoned RS, SINGLE FAMILY RESIDENTIAL SUBURBAN DISTRICT and Tracts D and E, described in Section 1 above, shall be zoned R-1, SINGLE FAMILY RESIDENTIAL DISTRICT. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
