ORDINANCE NUMBER 99-9924
AN ORDINANCE PROVIDING FOR THE VACATION OF THE 80 FOOT
RIGHT-OF-WAY OF SEVENTH STREET BEGINNING AT A POINT WHICH IS 12 FEET
SOUTH OF THE NORTH LINE OF LOT 9 ON SEVENTH STREET IN THE ORIGINAL
TOWNSITE OF SALINA, AND EXTENDING APPROXIMATELY 212 FEET NORTH TO
THE SOUTH RIGHT-OF-WAY LINE OF NORTH STREET OF THE CITY OF SALINA,
SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on May 3, 1999, the governing body conducted a public hearing on the
petition of Central Kansas Railway ("Petitioner") requesting vacation of the 80 foot right-of-way of
Seventh Street beginning at a point which is 12 feet south of the north line of lot 9 on Seventh Street
in the Original Townsite of Salina, and extending approximately 212 feet north to the south right-of-
way line of North Street in the City of Salina, Saline County, Kansas.
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by
law.
(b) No private rights will be injured or endangered by vacation of the
right-of-way.
(c) In justice to the Petitioner vacation of the right-of-way should be
granted.
Section 3. That the right-of-way is hereby vacated and shall revert to the owners of
Lots 1 through 8 and the north Twelve (12) feet of Lots 9 and 10, on Seventh Street in the Original
Townsite of Salina, in the City of Salina, Saline County, Kansas, provided however:
(a) The City retains the vacated right-of-way as a utility easement
described.
(b) Central Kansas Railway, L.L.C., shall design and construct a poured
cul-de-sac or hammerhead configuration in compliance with City of
Salina Standards as termination of the remaining North Seventh
Street.
(c) Central Kansas Railway, L.L.C. shall provide a public utility easement over the
entire existing right-of-way to be vacated at no cost to the owner.
Section 4. That this ordinance shall be in full force and effect from and after its
adoption and publication once in the official city newspaper.
