5968 Utility Imp Contract1 ORDINANCE NUMBER 5968 (Published in the Salina Journal 1955 ) AN ORDINANCE ratifying and confirming a contract with H. J. Taylor Construction Company for the construction of certain main sewer and lateral sanitary sewers in the City of Salina, Kansas, heretofore designated as Lateral Sanitary Sewer Districts 315, 316, 317, and 318, and providing for the issuance to temporary notes to pay the costthereof, pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the H. J. Taylor Construction Company, hereinafter referred to as the "contractor" as sub- mitted to the Board of Commissioners on June 28, 1955, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said cityta said contractor and signed on behalf of the City by its Mayor on July 5, 1955, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: An 8 inch clay pipe sewer beginning with a manhole "A" to be constructed on an existing sewer at the center line of Seminole Avenue and 90 feet south of the south line of Franklin Avenue thence north along the center line of Seminole Avenue 240 feet at which place a manhole "B" will be constructed with an 8 inch sewer branch (1) to west and an 8 inch sewer branch (2) east; the branch (1) wxtended west from said manhole "B" 140 feet where a manhole "C" will be constructed, thence north along center line of right-of-way 360 feet where a manhole "Dt' will be constructed being terminus of branch (1); thence beginning at manhole "B" with branch (2) thence east 140 feet where a manhole "E" will be constructed with branch (3) going north and branch (4) going east; branch (3) extends north from manhole"E" 360 feet where a manhole "F" will be constructed which is terminus of branch (3); branch (4) begins at manhole "E", thence east 257.5 feet where a manhole "G" will be constructed; thence north 360 feet where manhole "E" will be constructed which is terminus of Lateral 315• An 8 inch clay pipe sewer beginning at an existing man- hole in the center of Ohio Street and on the center line of easement for utilities in Block 8 of the Replat of Blocks 6 and 8, Claflin Addition to the Grounds of Kams Wesleyan University, thence west along center line of said easement 610 feet to a manhole to be constructed which will be terminus to Lateral 316. An 8 inch clay pipe sewer beginning at an existing man- hole in the center line of Lincoln Avenue and the center line of first alley east of Third Street extended south; thence south 180 feet where a manhole will be constructed with branch "A" going west and branch "B" extending south, branch "A" exgends along south edge of AT and SF right- of-way 320 feet to the center line of first alley east of Second Street; thence south 220 feet where a manhole will be built being terminus of branch "A", branch "B" begins at first manhole to be constructed thence south in alley first east of Third Street 80 feet where a manhole will be constructed which will be terminus of branch "B" and Lateral 317. An 8 inch clay pipe sewer beginning at an existing man- hole in the center line of Antrim Avenue and on the center line of first alley east of Fourth Street extended south; thence east along center line of Antrim Avenue 550 feet where a manhole will be constructed which will be terminus of Lateral 318. at and for the unit price for said work contained in said proposal, which proposal and con- tract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements 8 as shown by the sworn estimate of the City Engineer on file in the office of the City Clerk which estimate is hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. section 3. That temporary notes signed by the Mayor and attest by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price of $ 15,238.85 for such work, such notes to bear interest at not to exceed 42 per cent per annum and to mature not i later than December 1, 1956, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that Internal Improvement bonds are issued in lieu thereof. Section 4.
