paving and grading of Custer Street (twenty-eight (28) feet from toe of gutter to toe of gutter) with concrete, from the south line of Crawford Avenue to the south line of Republic Avenue; for the curbing, guttering, and grading on the east side and the paving with six-inch reinforced concrete twenty (20) feet wide from toe of gutter to edge of slab, West Place from the north line of University to the south line of State Street; and providing for the payment of the cost thereof, how the same shall be assessed, and the manner of the payment of the cost thereof. 1lHEREAS, by Resolutions Numbered 1535, 1521, 1520 1561, 1553, 1560, 1527, 1552, 1554, 1550, 1547, 1546, 1543, 1551, 1556, 1557, 1541, 1532, 1565, 1564, and 1544 duly adopted on March 29s 1955; February 1, 1955; January 25, 19555; May 17, 1955; may 3, 1955; February 15, 1955; April 26, 1955; April 19, 1955; April 12, 1955; March 8, 1955; May 24, 1955; by the Board of Commissioners of the City of Salina, Kansas, have declared that they deem it necessary to curb, gutter and pave with concrete (thirty-three (33) feet wide back of curb to back of curb Chicago Street from the center line of Broadway Boulevard, to the north right-of-way of the Union Pacific Railroad; to curb, gutter, pave and grade to a width of twenty-eight (28) feet toe of gutter to toe of gutter, Connecticut Avenue from the north line of Stack Avenue to the north line of Greeley Avenue; to curb, gutter, pave and grade Decatur Street, from the j east line of Santa Fe Avenue to the west line of Fifth Street; to Curb, gutter, pave and II' p grade Pershing Street, (thirty-three (33) feet from back of curb to back of curb) with Concrete from the north line of Claflin to the north line of Cloud; to pave and grade Charlotte Street j (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with concrete, from the east line of Simmons Street to the east line of NinthStreet; Highland Avenue (twenty-eight (28) feet wide from toe of gutter to toe of gutter) with concretes from the south line of Cloud Street to the north line of Charlotte Street; to pave and grade Larson Street (twenty.-eight (28) feet wide from toe of gutter to toe of gutter) with concrete from the south line of Cloud Street to the south line of Charlotte Street; to pave and grade Morningside Drive(twenty-eight (28) feet wide from toe of gutter to toe of gutter) with WHEREAS, each of the said resolutions were published for six days in the Sarna, Journal, a daily newspaper, published in said city, and being the official city paper, and the majority of the resident property owners owning a majority of the square feet of the lots or real es- tate from the liable to taxation for the cost of said improvements and did not within twenty days from the date of the last publication thereof, filed with the City Clerk a sufficient protest in writing against the making of said improvements, no protests of any kind having been filed, SO, NOW THEREFORE, BE 41T ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. that it is necessary and it is hereby ordered that Chicago Street, from the center line of Broadway Boulevard to the north right-of-way of the union Pacific Railroad.,', d be curbed, guttered and paved with concrete thirty-three (33) feet wide back of curb to back i s of curb, with excavation thereof, and graded to the established paving grade and paved be- tween the guttering lines thereof. Section 3. That it is necessary and it is hereby ordered that Funston Street, from the south line of Sunset Drive to the south line of Ellsworth, be paved and graded with concrete twenty-eight (28) feet from toe of gutter to toe of Butte; with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 7 That it is necessary and it is hereby ordered that Gyps Avenue, from the east line of Wisconsin Avenue to the east line of Missouri Avenue, be paved and graded with concrete, and with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 8. That it is necessary and it is hereby ordered that Highland Avenue, from the north line of Charlotte Street to the north line of Leslie Street, be paved and graded with concrete twenty-eight (28) feet wide from toe of gutter to toe of gutter, with excava- tion thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 9. That it is necessary and it is hereby ordered that Highland Avenue, from the south line of Cloud Street to the north line of Charlotte Street, be paved and graded with concrete, twenty-eight (28) feet wide from toe of fitter to toe of gutter, with excava- tion thereof, and graded to the edablished paving grade and paved betweenthe guttering lines thereof. Section 10. That it is necessary and it is hereby ordered that Larson Street, from the south line of Cloud Street to the south line of Charlotte Street, be paved and graded with concrete, twenty-eight (28) feet wide from toe of gutter to toe of gutter, with ex- cavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 11. That it is necessary and it is hereby ordered that Morningside Drive, from the east line of Sunrise Drive to the west line of Roach Street, be paved and graded with concrete, twenty-eight (28) feet wide from toe of gutter to toe of gutter, with excava- tion thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 12. That it is necessary and it is hereby ordered that Simmons Street, from the south line of Charlotte Street to the south line of Leslie Street, be paved and graded with concrete, twenty-eight (28) feet wide from toe of gutter to toe of gutter, with excava- tion thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 13. That it is necessary and it is hereby ordered that Simmons Street, from the south line of Cloud Street to the north line of Charlotte Street, be paved and graded with concrete, twenty-eight (28) feet wide from toe of gutter to toe of gutter, with excava- tion thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 14. That it is necessary and it is hereby ordered that Tenth Street, from the north line of Frost Street to the south line of Franklin Street, be paved and graded with concrete, twnty-eight (28) feet wide from toe of gutter to toe of gutter, with excava- tion thereon:, and graded to the established paving grade and paved between the guttering 1 C lines thereof. Section 15. That it is necessary and it is hereby ordered that Larson Street, from the north line of Charlotte Street to the south line of Leslie Street, be paved and graded with conctete, twenty-eight (28) feet wide from toe of gutter to toe of gutter, with exca- vation thereof, and graded to the established paving grade and paved between the guttering lines thereof. section 16. that it is necessary and it is hereby ordered that Third Street, from the south line of Lamar Street to the north line of Lamar Street, be paved and graded with concrete, twenty-eight (28) feet wide from toe of gutterto toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 17. That it is necessary and it is hereby ordered that Third Street, from the north line of Republic Avenue to the south line of Lamar Street, be paved and graded with reinforced concrete, tmty-eight (28) feet wide from toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 18. That it is necessary and it is hereby ordered that Wisconsin Avenue, from the south line of iron Avenue to the north side of Gypsum Avenue, be paved and graded with concrete, thirty-three (33) feet back of curb to back of curb, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 19. 'haat it is necessary and it is hereby ordered that Cloud Street, from the west line of Ninth Street to the east side of highway slab on 81 by-pass, be paved and graded with concrete, thirty-two (32) feet wide from toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 20. That it is necessary and it is hereby ordered that Custer Street, from the south line of Crawford Avenue to the south line of Republic Avenue, be paved and graded with concrete, twenty-eight (28) feet from toe of gutter to toe of gutter, with excavation thereof, and graded to the established paving grade and paved between the guttering lines thereof. Section 21. That it is necessary and it is hereby ordered that Hest Place, from the north line of Vaiversity to the south line of State Street , be curbed, guttered and graded on the east side and the paving with six-inch reinforced concrete, twenty (20) feet wide from toe of gutter to edge of slab, with excavation thereof, and graded to the estab- lished paving grade and paved between the guttering lines thereof. Section 22. That for the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 5th day of July , 1955, complete plans and specifications for the curbing, guttering, paving and grading with excavation necessary therefore, of each of the street or portions thereof described in ;lection 1 to 21, both inclusive of this ordinance, with the following type of improvements: Concrete combined curb and gutter on each side thereof, 30 inches wide from back of curb to paving line, curb 1 I 12 inches deep at back, gutter 6 inches deep; and the necessary grading of each to the established paving grade, and thepaving thereof with 6" reinforced concrete, pro- vided that in the event of the non-availability of reinforced material that then said pavement shall be constructed with concrete to a depth of 7 inches between the curb and gutter line on each side thereof and within j 4 the limits of said streets hereinbefore described. The streets between the guttering lines and within the limits hereinbefore defined shall be graded to the established paving grades and paved with reinforced concrete six inches deep, provided that in the event of the non-availability of reinforcing material, then that said pavement shall be constructed with concrete to a depth of seven inches deep. and said Engineer shall on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of such work and improvements. Section 23 That after such plans and specifications have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise published advertisement in the official city paper of the City of Salina, iCansas, for three consecutive days for the receipt of sealed proposals for the improving of s said streets with the kind of material named and specified in the preceeding sections here- i of, and for the excavating and grading necessary for the completion of said work, and after the receipt of such proposals, the said Board of Commissioners may and are hereby authorized and directed to let contracts for the improving of said streets with the materials selected 3 by them to the lowest responsible bidder or bidders thereof, as determined by the Board of Commissioners, and for such excavation and grading. Said Board reserves the right to reject any and all bids. Section 24. That for the improving of the above mentioned streets, such assessments shall be made for the full cost thereof according to law on all lots and pieces of land to the center of the block on either side of the streets to be improved according to the ap- praisers valuation thereof, without regard to the buildings or improvements thereon for the distance to be improved. Section 25. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impttial appraisement, of all lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Com- missioners of said city, without regard to the buildings or improvementsthereon and after making such appraisement shall return to the Board of Commissioners of said city and said Board of Commissioners sahll designate a time and place for the hearing of any com] i.nts that may be made as to the value of any lots and pieces of land appraised as aforesaid, of which due notice shall be given in the official city paper, at which hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if, in their opinion, the same has been apraised too high or too low. Section 26. That for the purpose of paying the cost of the work and improvements in this ordinance provided for, the Board. of Commissioners are hereby authorized and direct- ed to issue internal improvement bonds of the City of Salina in an amount not to exceed the contract price for the cost of such improvements and to run for a period of ten years and be payable in ten equal installments, together with interest not to exceed five per cent ......... .... . 1 1 1 per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas and! for the prupose of paying the principal and interest on said bonds as they severally become I due and payable the Board of Commissioners saall apportion and assess pp against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improving and the apportionment herein contained shall hold good for all i of the installments that are to be collected fom the specific property chargeable with said im provements. Such assessments and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and i shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Salina, County, Kansas, a full list of all property liable to such work and assessments together with the respective pective amounts due on each of said tracts, pieces of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum on such amounts so certified which shall be collected as other taxes are collected,• PROVIDED,' that for the purpose of defraying the cost of improving the intersections and areas formed by the crossing of streets and alleys, and for the grading of said streets where the same is provided for in this ordinance as well as where the improvement is through or adjacent to property of the city for wjiich the city is liable, the assessment will be made against all taxable property of the city and paid by the city at large. Section 27. This ordinance shall take effect and be in force from and after its publication once in the official city paper.
