ORDINANCE NUMBER 5964

AN
AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the city of
Salina, Kansas, designated as Lateral Sanitary Sewer District Number 319 and providing for
the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number
319, so created, and providing for the payment of the cost thereof and for the levying of
special assessments against the property in said district for the payement fcrthe cost of
such construction and for the issuing of bonds to pay the cost thereof.
BE IT ORDAINED by the Board of Comi.ssioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 319. That there be and there is
hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be
and it is hereby designated as Lateral Sanitary Sewer District Number 319 and which district
shall include all the following described property in the City of Salina, Kansas, to -wit:
Benefit District: Block 3, Replat of Garden Homes
Addition, City of Salina, Saline County Kansas.
Section 2. It is necessary and it is hereby ordered that an eight -inch V. C. P.
lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other
appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District
Number 319 as created by Section 1 of this ordinance along the following course, to -wit:
An eight -inch clay pipe sewer beginning at a manhole
which is 23 feet east of the west line of Front Street
and 50.9 feet north of the north line of Lot 8, Block
3, Vantrine Addition; thence south easterly in East
Prescott Road 172 Feet and 10 feet north of the north-
east corner of Lot 6, Block 3 the Replat of Garden
Homes Addition; thence south along the center line of
utility easement 305 feet to the northwest corner of
Lot 10, Block 3, Replat of garden Homes Addition at
which place a manhole will be built with a stub to
the northeast corner of Lot 1 and a stub to the
northwest corner of Lot 11 both being in Lot 3,
Replat of Garden Homes Addition and this being the
terminus of Lateral 319.

Section 3. That the City Engineer shall on or before . 1955, prepare
and file in the office of the City Clerk, plans and specifications for the construction of the
lateral sanitary sewer provided for in the proceeding sections of this ordinance which shall
be of the proper character to serve the property lying within the district for which such
sewer is to be constructed and shall on or befre the same date prepare and submit to the
Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter
the City Clerk shall advertise for three consecutive days in the official city paper for
sealed ]proposals for the building and construction of such a sewer according to such plans

and specifications, which proposals shall be filed with City Clerk on or before the time fixed
in such notice, at which time the Board of Commissioners may let a contract for the building
and construdion of such sewerin the lowest and best responsible bidder or bidders therefore,
if there be any whose bids do not exceed the estimated cost thereof, but said Board shall
reserve the right to reject any or all such proposals, and if no bids shall be received Ath-

such improvements within the estimated cost thereof as provided by law.

unpaid at the end of thirty days from the time such assessment is fixed.
Section 7 For the purpose of paying for the work and improvements in this ordinance
provided for, the Board of Commissioners may and are hereby authorized and directed to issue
improvement bonds of the City of Salina, Kansas, on an amount not to exceed the total cost of
such improvement, and to run for a period of four years and be payable in four approximately
equal annual installments, together with interest not to exceed five per cent per annum,
which bonds shall be issued and payable according to law; and for the purpose of paying the
principal and interest on said bonds as they severally become due and payable the Board of
Commissioners shall apportion and assess against the lands and pieces of land within the tax-
ing district of such improvements, special assessments covering the cost of such improvement
and apportionment therein contained shall hold good for all of the installments that are to
be collected from the specific property chargeable therefore, with such improvements; such
assessment and apportionment ordinance shall contain the total amount of tax apportioned to
such tract, piece or parcel of land within the taxing district and shall state the number of
annual installments in which such tax is to be collected; and thereafter the City Clerk shall
annually, at the same time that other taxes are certified, certify to the County Clerk of
Saline County, Kansas, a full list of all peoperty liable for such work and improvement, to-
gether with the respective numbered amounts due on each of said tracts, pieces or parcels of
land, which amounts shall include the annual installments and interest on all unpaid balances
Section 4. That for the cost of building and construction of such sewer, special
assessments shall be for the full
made cost thereof on all lots and pieces of land within and
for which such sewer shall be built, according to the appraised value thereof, without regard
to the buildings or improvements thereon.

Section 5. After the passage and publication of thiscrdinance, the Board of Commis-
sioners shall appoint three distinterested appraisers, who after haing taken oath to make a
true and impartial appraisement of all lots and pieces of land liable to taxation for the

cost of such improvements, shall within five days after having been notified of their appoint-
ments proceed to appraise all of the lots and pieces of land within the district liable to
assessment and taxation as aforesaid, without the regard to the buildings or improvements
thereon, and after making such appraisements, shall return to the Board of Commissioners of
said city and said Board shall designate a time for a special meeting of said Board for the
purpose of hearing any complaints that may be made as to the value of any lot or piece of
land appraised as aforesaid, of which special session due notice shall be given in the offi-
cial city paper, at which special session said Board may alter any valuation of any lot or
piece of land, if, in their opinion, the same has been appraised too high or too low.
Section 6. The special assessmentYarein provided for may be paid by the person
liable therefore in four approximately equal annual install .ments but the owner of any pro-
perty liable to such assessment may within thirty days from the date
of determining the
amount assessed against the property, pay the same in full and his property so paid on shall
not be liable for any assessments for the cost of such improvements, and bond s as herein-
after provided for shall be issued in an amount of the cost of such improvements remaining
unpaid at the end of thirty days from the time such assessment is fixed.
Section 7 For the purpose of paying for the work and improvements in this ordinance
provided for, the Board of Commissioners may and are hereby authorized and directed to issue
improvement bonds of the City of Salina, Kansas, on an amount not to exceed the total cost of
such improvement, and to run for a period of four years and be payable in four approximately
equal annual installments, together with interest not to exceed five per cent per annum,
which bonds shall be issued and payable according to law; and for the purpose of paying the

which amounts shall be collected as other taxes are collected.
Section 8. This ordinance shall take effect and be in force from and after its
publication once in the official city Paper.
