AN ORDINANCE relating to and apportioning and levying special assessments on certain lots
and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing, guttering,
paving and grading with two -irk hot mixed asphaltic concrete over a six-inch rock stabilized
base, 32 feet wide from face of curb to face of curb Birch Drive from the north line of Lot
9, Block 8 and the north line of Rt 23, Block 7, all in Replat of Edgemere Addition to the
west line of Hemlock Drive; grading, and paving with two-inch hot mixed asphaltic concrete
over a six-inch rock stabilized base, Hemlock Drivq 28 feet toe of gutter to toe of gutter
from the north line of Lot 7, Block 9, Replat of Edgemere Addition to the south line of
Redwood Drive; curbing, guttering, and grading of Hemlock Drive from the north line of Lot
7, Block 9, Replat of Edgemere Addition to the center line of Redwood Drive; and relating to
and providing for the collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following sections of
this ordinance which is chargeable to the private property in the assessment district for
such improvements as set forth in the following sections of this ordinance with respect to
such improvements there are hereby levied, and assessed on the property liable therefor,
being all the lots and pieces of ground lying on either side of said street so improved, to
the middle of the block for the distance improved, with respect to the improvements men-
tioned in Sections 2 and 3 of this ordinance, according to the appraised value of such
lots and pieces of ground with respect to such improvements, without regard to the build-
ings or improvements thereon, special assessments covering the cost of such work and im-
provements, said special assessments being based on the special valuation and appraisement
of said lots and pieces of ground heretofore made by three disinterested appraisers appoint-
ed by the Board of Coaaai.ssioners of the City of Salina.. Kansas, with respect to such im-
provements, which said appraisement is hereby referred to and made a part of this ordinance,
and the several amounts so levied, apportioned and assessed against the lots and pieces of
sound for such improvement, for the purpose aforesaid, are hereby found and determined to be
the amounts set forth in the following sections of this ordinance with respect to each of
said improvements.
Section 2. For that part of the cost of curbing, guttering, paving and grading with
two-inch hot mixed asphaltic concrete over a six-inch rock stabilized base, 32 feet wide
from face of curb to face of curb Birch Drive from the north line of Lot 9, Block 8 and the
north line of Lot 23, Block 7, all in Replat of Edgemere ,Addition to the west line of Hemlock
Drivep which is chargeable against the private property within the district chargeable there-
for, and which cost is hereby determined to be $10,029.49, there is hereby levied, apportion-
ed and assessed against the following described lots and pieces of land as provided for in
Section 1 of this ordinance, the following amounts:

Section 3 For that part of the cost of grading and paving and curbing and guttering
with two-inch hot mixed asphaltic concrete over asix-inch rock stabilized base Hemlock
Drive, 28 feet toe of gutter to toe of gutter from the north line of Lot 7, Block 9, Replat
of Edgemere Addition to the south line of Redwood Drive,, which is chargeable against the
privater
p operty within the district chargeable therefor, and which cost is hereby deter-
mined to be $5,064.12, there is hereby levied, apportioned and assessed against the follow-
ing described lots and pieces of land as provided for in Section 1 of this ordinance, the

Section 4. said amounts so levied, apportioned and assessed as aforesaid shall be due
and collectible in ten equal installments, the first becoming due with the taxes levied for
the year 1955, and one of said installments falling due each and every year thereafter
until all are paid, and all to be collected with interest as in this ordinance provided,

however that the owner of any piece or pieces of property liable for any such assessment may'
redeem his property from such liability by paying into the City Treasurythe entire amount
chargeable against the same as in this ordinance designated., at any time within thirty days
after �he publication of this ordinance and before the issuance of bonds of said city in pay -
of the balance of the cost of said improvements, the property so paid on shall not there-
after be liable for any further assessments for the cost of said impovements nor for any
part of said bonds.
Section 5. There is hereby levied further and assessed against such lots and pieces

of ground described in this ordinance, interest at such rate per annum as shad], be borne by
the bonds hereafter to be issued for the payment of the remaining unpaid cost of such in-
provements, to be hereafter determined and fixed by ordinance when such bonds are issued,
on all of said installments mentioned and provided for in this ordinance, from the date of
the bonds which may be issued at the end of thirty days as specified in the preceding sections
hereof, as by law provided, to the time of the collection of the installment as provided by

law, which said interest shall be collected annually at the same time and in the same manner
as said installments are collected and after the taking effect of this ordinance and the
fixing of the said interest rate when such bonds are authorized and issued, it shall be the
duty of the City Clerk of said City to annually at the same time other taxes are certified
and until all of said assessments so apportioned and levied have been certified to the
County Clerk of Saline County, Kansas, a full list of all property liable to assessment and
taxation for such work and improvement except such property on which the special assessments
aforesaid have been paid in full as hereinbefore provided, together with the respective
amounts due on each of such lots and pieces of ground which amounts shall include the annual
installments of such special assessments together with the interest for one year at the
rate to be fixed as provided for in this ordinance, on all unpaid balances os such assess-
ments, and such amounts so certified as herein provided shall be placed upon the tax roll
by the County Clerk of Saline County, Kansas, and collected as other taxes are collected.
Section 6. This ordinance shall take effect and be in force from and after its
adoption and publication once in the official city paper.
