ORDINANCE NUMBER 5958

AN ORDINANCE ratifying and confirming a contract with Brown & Brown, Inc., for the con-
struction of certain curb and gutter and paving and grading improvements on certain streets
in the City of Salina, and providing for the issuance of tempvrary note to pay the cost
thereof pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of
the Brown & Brown Construction Co., Inc., hereinafter referred to as the "Contractor" as
submitted to the Board of Commissioners on May 10, 1955, which is hereby found to be the
lowest and best bid for such work, and the contract awarded by the Beard of Commissioners
of said City to said contractor and signed on behalf of the City by its Mayor on May 17,
1955, for the construction of certain public improvements in the City of Salina, Kansas
to -wit:
Resurfacing of Iron Avenue with two-inch hot mixed
asphaltic concrete from the west line of Delaware
Avenue to the East line of Fifth Street, by Reso-
lution Number 1528 and Ordinance Number 5953
Curbing, guttering and paving with two-inch hot
mixed asphaltic concrete over a six-inch rock
stabilized base, Cherokee Drive, from the south
line of Pueblo Avenue to the center line of Republic j
Avenue, by Resolution Number 1517 and Ordinance
Number 5953
Curbing, guttering, paving, and grading to a width
of Thirty Six (36) feet from back to back of the
curbing, with two-inch hot mixed asphaltic concrete
over a six-inch rock stabilized base, Front Street
from the north line of Crawford Avenue, thence north
to the North line of Prescott Avenue, by Resolution
Number 1519 and Ordinance Number 5953
Curbing, guttering, paving and grading with two-inch
hot mix asphalt over a six-inch crushed rock base
Twenty-eight (28) feet wide from toe of gutter to
toe of gutter Kirwin Avenue from the east line of
Lewis Avenue to the west line of Ohio Street, by
Resolution Number 1525 and Ordinance Number 5953
Grading and paving, with two-inch hot mixed asphaltic
concrete over a six-inch rock stabilized base, Kirwi.n
Avenue, from the east side of Roach Street to west
side of Lewis Avenue, by Resolution Number 1513 and
Ordinance Number 5953
Grading and paving with two-inch hot mixed asphaltic
concrete over a six-inch rock stabilized base, on
Kansas Avenue, from the north line of Ash Street to
the south line of Elm Street, by Resolution Number
1510 and Ordinance Number 5953
Grading and paving(to a width of twenty-eight (28)
feet from toe of gutter to toe of gutter) with two-
inch hot mixed asphaltic concrete over a six-inch
rock stabilized base, Lewis Avenue from the north
line of Martin Avenue to the south line of McAdams
Road, by Resolution Number 1499 and Ordinance Number
5953
Curbing, guttering and paving with two-inch hot mixed
asphaltic concrete over a six-inch rock stabilized
base, Redwood Drive from the west line of Cherokee
Drive i_oVh_ee`ast line of Willow Court, by Resolution
Number 1518 and Ordinance Number 5953
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is hereby

ratified and confirmed, said proposal being within the estimated cost of said improvements
as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk,
which estimates are hereby referred to and made a part of this Ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications threfore prepared by the City Engineer on file in the office of
the City Clerk and in accordance with the proposal of said contractor and under the terms j
of said contract, all of which are hereby referred to and made parts of this ordinance.

Section 3. That temporary notes signed by the Mayor and attested by the City Clerk '
be issued from time to time as the work progresses in the manner and form as required by
law, the total amount thereof not to exceed the contract price of $120,034.20, for such

8 work, such notes to bear interest not to exceed 42 per cent per annum and to mature not j
later than December 1, 1956, and to be issued in such amounts and at such time as money

for the payment of the cost of such notes being issued to said contractor and to be redeemed

and cancelled at the time that permanent bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after its pub-
lication once in the official city paper.
