5935 Utility Improvements1 1 ORDINANCE NUMBER 5935 (Published in the Salina Journal�?� mss, f 11955) AN ORDINANCE creating and defining certaLn lateral sanitary sewer districts in the City of 'Salina, Kansas, designated as Lateral Sanitary Sewer Districts Numbered 312 and 313, and pro- dviding for the construction of a lateral sanitary sewer in each of said lateral Sanitary Sewer; FDistricts Numbered 312 and 313, so created, and providing for the payment of the cost thereof ;and for the levying of special assessments against the property in said districts for the pay- !. ment of the cost of such construction and for the issuing of bonds to pay the cost thereof. f , BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District Number 312. That there be and there is hereby created lateral sanitary sewer district in the City of Salina, Kansas, which shall I i be and it is hereby designated as Lateral Sanitary Sewer District Number 312 and which district; shall include all the followingdescribed property in the City of Salina, Kansas, to -wit: Benefit District: Lots 14-15-16-3:7-18-19, Block 10, Oakdale Addition to the City of Salina, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch B.C.P. Lateral Sanitary Sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 312 as created by Section 1 of this ordeinance along the following course, to -wit: An 8 inch clay pipe sever beginning at a mnahole in the center line of Kansas Avenue and the center line of 20 foot alley, 531 feet south of the south line of Iron Avenue, thence east 310 feet where a manhole will be constructed which will be terminus of Lateral 312. Section 3. Lateral Sanitary sewer District Number 313. That there be and there s hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall and it is hereby designated as Laterla Sanitary Sewer District Number 313 and which dis- ct shall include all the following described property in the City of Salina, Kansas, to -wit: Benefit District. All of Blocks 7 and 8, Riker Addition, City ofS111na, Kansas. Section 4. It is necessary and it is hereby ordered than an eight inch V. C. P. sanitary sewer with all necessary connections, manholes, flushing tanks and other nances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 313 as created by Section 3 of this ordinance along the following course, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole which is 7 feet west of the center line of Ohio Street and 109.35 feet north of the north line of McAdams Road; thence westalong center line of easement in Blocks 7 and 8, Riker Addition to a point 50 feet east of the east line of Roach Street, where a manhole will be constructed which will be terminus of Lateral A 313. Section 5. That the City Engineer shall on or before March 1 55, prepare and file in the office of the City Clerk, plans and specifications for the con - on of the lateral sanitary sewer provided for in the preceeding sections of this or - which shall be of the proper character to serve the property lying within the district ch such sewer is to be constructed and shall on or before the same date prepare and submit o the Board of Commissioners a detailed estimate under oath of the cost thereof. That there - the City Clerk shall adbertise for these consecutive days in the official citypaper for proposals for the building and construction of such sewer according to such plans and cification, which proposals shall be filed with the City Clerk on or before the time fixed n such notice, at which time the Board of Commissioners may let a contract for the building I � I and construction of such sewer to the lowest and best responsible bidder or bidders therefore,; if there beany whose bids do not exceed the estimated cost thereof, but said Board shall re- serve the right to reject any or all such proposals, and if no bids ahll be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 6. That for the cost of building and construction of such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and! 4 a for which such sewer shall be built, according to the appraised balue thereof, without regard! j to the building or improvements thereon. Section 7, After the passage and publication of this ordinance, the Board of Commissioners shall appoint three ddisinterest appraisers, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land within the district ii - able to assessment and taxation as aforesaid, without regard to the building or improvements thereon and after amkin such g a ppraisements, shall return to the Board of Commissioners of II said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the offic- ial city paper, at which special aession said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high of too low. Section 8. The special assessment herein provided for may be paid by the person liable therefore in four approximately equal annual installments but the oweer of any prop- erty liable to such assessment may within thirty days from the date of determining the amount j assessed against the property, pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for I shall be issued in the amount of the cost of the such improvements remaining unpaid at the end of the thirty days from the time such assessment is gixed. Section 9. For the purpose of paying for the work and improvements in this or- dinance provided, for the Board of Commissioners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of such improvement, and to run for a period of four years and abe payable in four approximately equal annual installments, together with interest not to exceed the total cost of such improvements, and to run for a period of four years and be payable in four approximately equal annual installment, together with interest not to exceed five per cent p per annum, which bonds shall be issued and payable according to lav; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements, special assessments covering the cost of such im- i provement that are to be collected from the specific p property chargeable therefore, and with such improvements; such assessment and gpionment ordinance shall contain the total amount i i :of tax apportioned to each such tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and there- after the City Clerk shall annually, at the same time that other taxes are certified, certify 'to the County Clerk of Saline County, Kansas, a full list of all property liable for such work' and improvement, together with the respective amounts due on each of said tracts, pieces or parcels of land, which amounts shall include the annual installment and interest on all un - ,paid balances for one year at the rate of not to exceed five per cent per annum on such amount r ,so certified, which amounts shall be collected as other taxes are collected. Section 10. This ordinance shall take effect and be in force from and after its publication once in the official citypaper.
