5930 Utility Improvements---------------------- --- ORDINANCE NUMBER 5930 (Published in the Salina Journal 1955 ) AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 311 and providing for 1 the construction of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 311, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District Number 311. That there be and i i thereis hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number a 311 and which district shall include all the following described property in the City of Salina, g i Kansas, to -wit: Benefit District: Land east of Tract 4, Plat 51, west of US 81 By-pass, less the north 120 feet, a part of northwest 1/4 of section 14, T14S, Rawest. Described as follows: Beginning at a point on the west line of US 81 By-pass, (Broadway Blvd.) and one hundred and eighty one and five tenths feet (181.51) North of the south line of the north west quarter of section 14, T14S, R3W, P.M. thence west, one hundred and sixty five feet, (165') thence north two hundred and sixteen and five tenths feet, (216.51) thence east one hundred and sixty five feet, (165') " thence south two hundred and sixteen and five tenths feet, (216.51) to the point of beginning. Section 2. It is necessary and it is hereby ordered that an eight inch ii. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other a appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District I Number 311 as created by Section 1 of this ordinance along the following course, to -wit: An 8 -inch clay pipe sewer beginning at an existing sewer which is 13.4 feet: east of the west line of Broadway Boulevard and 112 feet wouth of the north line of the southwest quarter of Section 14, T14S, R31T, thence north 500 feet where a manhole will be constructed which will be terminus of lateral. Section 3. That the City Engineer shall on or before January 24th 1955, prepare and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for in the proceeding sections of this ordinance which shall be of the proper character to serve the property lying within the dis- trict for which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such time notice, at which the Board of Commissioners may let a i 1 contract for the building and construction of such sewer to the lowest and best responsible I bidder or bidders therefore, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if C 1 Ino bids shall be received within such estimate, the Board of Commissioners shall have the ;power to do such work and make such improvements within the estimated cost thereof as provided !by law. Section 4. That for the cost of building and construction of such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof,without regard oto the buildings or improvements thereon. Section 5. After thepassage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after having taken oath to make a true and impartial appraisement of all lots and pieces of land liable to taxation for the cost of such improvements, shall within five days after havein been notified of their appointments proceed to appraise all of the lots and pp p pp pieces of land within thedistrict liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after making such appraisements, shall return to the Board of Co;anissioners of i Siad city and said Board shall designate a time for a special meeting of s&i.d Board for the of hearin- an complaints that may be made as to the value of an lot or purpose � Y P Y y piece of i land appraised as aforesaid, of which special session due notice shall be given in the of - ficial city paper, at which special session said Board may alter any Val.uAtion of any lot or piece of land, if, in their opinion, the same has abeen appraised too high or too low. Section 6. The special assessment herein provided for may be paid by the person liable therefore in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the date of determining the amount as- sessed against the property, pay the same in full and his property so paid on shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter pro- vided for shall be issued in an amount of the cost of such improvements remaining unpaid at thirty the end of %ME= days from the time such assessment is fixed. Section j. For the purpose of paying for the work and improvements in this Sordinance provided for, the Board of Commissioners may and are hereby authorized and dir- ected to issue improvement bonds of the City of Salina, Kansas, on an amount not to exceed the total cost of such improvement, and to run for a period of four years and be payable in four approximately equal annual installments, together with interest not to exceed five per cent per annum, i= which bonds shall be issued and payable according to law; and for the purpose of paying the princiapal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the in- stallments that are to be collected from the specific property chargeable therefore, with such improvements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to such tract, piece or parcel of land within the taxing district and shall i state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work i fond improvement, together with the respective numbered amounts due on each of said tractsi, +pieces or parcels of land, which amounts shall include the annual installment and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum on ;such amounts so certified, which amounts shall be collected as other taxes are collected. l Section 8.
