06-10324 Vacate Indian Rock(Published in the Salina Journal on March ) 0, 2006) ORDINANCE NUMBER 06-10324 AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF A 14 - FOOT UTILITY EASEMENT ALONG THE SOUTHEAST PROPERTY LINE OF LOT 17, BLOCK 7 OF THE REPLAT OF INDIAN ROCK ADDITION IN THE CITY OF SALINA, w SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: a Section 1. That on February 27, 2006, the governing body conducted a public hearing on the petition filed by Sean Fischer ('Petitioner") requesting vacation of a 14 -foot utility easement along the southeast property line of Lot 17, Block 7 of the Replat of Indian Rock Addition in the City of Salina, Saline County, Kansas. that: Section 2. That the governing body finds from the evidence presented at the public hearing (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by the vacation of the alley. (c) In justice to the Petitioner alley vacation request should be granted, provided the alley be retained as a public utility easement. Section 3. That the portion of the utility easement as described in Exhibit "A" is hereby vacated and shall revert back to the property owner of Lot 17, Block 7 of the Replat of Indian Rock Addition. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
