06-10318 Zone Fruitland Add1 1 (Published in the Salina Journal on February1, 2006) ORDINANCE NUMBER 06-10318 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the I ezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -111. PLANNED RESTRICTED BUSINESS DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as apart of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to -wit: Lot Fourteen (14) and the East Thirty Feet (30') of Lot Thirteen (13) except the North Forty -Seven (47') of said lots, Block One (1) of the Fruitland Addition to the City of Salina, Saline County Kansas and addressed as 1125 E. Iron Avenue. shall become a part of District "PC -1". PLANNED RESTRICTED BUSINESS DISTRICT. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the RESTRICTED BUSINESS DISTRICT, except that the five foot landscape buffer required in Section 42-65(6)b. shall not be required on said property. Development of the property shall be subject to the plans on file with the City Planning Commission and/or City Clerk and the following conditions, to -wit: Permitted uses shall be limited to business and professional offices, group day care centers and single-family dwellings. 2. The driveway on East Iron Avenue shall be limited to entrance only. The abutting property owner to the north shall grant written permission to allow the proposed Connecticut Avenue driveway approach to encroach on their property prior to issuance of a driveway permit. If permission is denied, the site plan shall be amended to show the driveway entirely on the above described property. 4. Development of the site shall substantially conform to the approved site development plan which is herein incorporated by reference. No additional development shall take place on this property without approval of an amendment of this planned commercial district. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
