An ordinance granting to the Union Pacific Railroad Company a certain
right of gray over, upon and across certain streets and alleys
in the City of Salina,'Kansas, and repealing Ordinance No.
1171.
Be it ordained by the Mayor -.and Councilmen of the City of Salina:
Section_ 1. That there be and is hereby granted to the Union
Pacific Railroad Compant, its successors and assigns, the right to con-
struct, maintain and operate, in the city of Salina, a single sidetrack
or s`vitch from a connection with its railroad track on Fourth street,
north. of Ash street, over and across Fourth street, in a northwesterly
direction, upon and across the alley between Fourth and Fifth streets
and across Fifth street, and across the alley between Fifth street and
Santa Fe avenue, to the east line of Santa Fe avenue at or near the
north line of lot numbered fifty-five (55) on Santa Fe avenue, in said
city of Salina;subject, however, to the conditions inthis ordinance
named.

Sec. 2. Said sidetrack or xy",shall be constructed and main-
tained at the established grade of said streets and alleys, and said
Union Pacific Railroad company shall provide and maintain suitable
crossings over said sidetrack or switch where the same crosses said
Fourth and Fifth streets and said alleys between Fourth and Fifth
streets and between Fifth street -and Sant -w -re avenue-;- andshad prdv de
and maintain suitable and sufficient culverts and vrater ways under the
same when, where and as directed by order of'the mayor and council of
said city.
Sec. 3. That the right of vray hereby granted shall be and re-
main subject to all reasonable regulations now or hereafter enacted by
the mayor and caunc it of said city; of Salina.
Sec. 4. That if the said. Union Pacific Railroad company shall
fail or neglect to construct said sidetrack or switch within �
months from the date of the passage of this ordinance, all t lie rights
herein granted to such comp—any shall be forfeited and revert to said
city. h
See. 5. That Ordinance No 1171, passed and approved January
19, 1903, he and the same is hereby repealed.
Sec.. 6. This ordinance shall
