ORDINANCE NUMBER 01-10026
AN ORDINANCE PROVIDING FOR THE VACATION OF A PART OF THE
DRAINAGE EASEMENT LOCATED ON LOT 1, BLOCK 1, REPLAT OF SALINA
PRESBYTERIAN MANOR INC. SUBDIVISION, IN THE CITY OF SALINA, SALINE
COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on March 19, 2001, the governing body conducted a public hearing on the
petition of Shawn O'Leary, Director of Engineering and General Services of the City of Salina
("Petitioner") requesting vacation of a part of a drainage easement located on Lot 1, Block 1, Replat of
Salina Presbyterian Manor Inc. Subdivision in the City of Salina, Saline County, Kansas, more
particularly described as follows:
Beginning at the Southwest Corner of said Lot 1, Block l;
- thence North Eighty-nine degrees, Twenty-two minutes, and
Twenty-seven seconds East (N 89°2227"E), along the South line of
said Lot 1, a distance of Thirty (30.00) feet to the East line of said
drainage easement;
- thence North Zero degrees, Zero minutes and Zero seconds East
(N 00°00'00"E), along the East line of said easement, a distance of
Fifty-nine and Four Hundredths (59.04) feet to the Point of Beginning.
- thence South Eighty-nine degrees, Twenty-two minutes, and
Twenty-seven seconds West (S 89°22'27"W), parallel with the South
line of said Lot 1, a distance of Fifteen and Sixty Hundredths (15.60)
feet;
- thence North Zero degrees, Zero minutes, and Zero seconds East,
(N 00°00'00"E), a distance of Fifty-two and Seventy-four Hundredths
(52.74) feet;
- thence North Eighty-nine degrees, Twenty-two minutes, and
Twenty-seven seconds East (N 89°22'27"E), parallel with the South
line of said Lot 1, a distance of a distance of Fifteen and Sixty
Hundredths (15.60) feet to the East line of said drainage easement;
- thence South Zero degrees, Zero minutes, and Zero seconds
West (S 00°00'00"W), along said East line, a distance of Fifty-two and
Seventy-four Hundredths (52.74) feet, back to the Point of Beginning.
The above described parcel of land contains Eight Hundred Twenty-three (823) square feet
or Nineteen Thousandths (0.019) acres more or less and is shown in Exhibit "B".
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the
drainage easement.
(c) In justice to the Petitioner vacation of the drainage easement way
should be granted.
Section 3. That the above described drainage easement is hereby vacated and
full right of use shall revert back to the owners of Lot 1, Block 1, Replat of Salina
Presbyterian Manor Inc. Subdivision in the City of Salina, Saline County, Kansas
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
