AN ORDINANCE PROVIDING FOR THE VACATION OF A DRAINAGE
EASEMENT LOCATED ON THE FIRST SOUTHERN BAPTIST CHURCH PROPERTY AT
SOUTH OHIO STREET AND MAGNOLIA ROAD IN THE NORTHWEST QUARTER (NW'/4)
OF SECTION 31, TOWNSHIP 14 SOUTH, RANGE 2 WEST OF THE 6TH PRINCIPAL
MERIDIAN, IN THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on March 19, 2001, the governing body conducted a public hearing on the
petition of Shawn O'Leary, Director of Engineering and General Services of the City of Salina
("Petitioner") requesting vacation of a drainage easement located in the Northwest quarter (NWl/4) of
Section 31, Township 14 South, Range 2 West of the Oh Principal Meridian, in the City of Salina, Saline
County, Kansas, more particularly described as follows:
Beginning at the Northwest Corner of said Section 31;
- thence South Zero degrees, Zero minutes, and Zero seconds West
(S 00°00'00"W), a distance of Five Hundred Sixty-one and Twenty-
three Hundredths (561.23) feet;
- thence North Eighty-nine degrees, Two minutes and Fifteen
seconds East (N 89'02'15"E), a distance of Seventy and One
Hundredth (70.01) feet to the Point of Beginning.
- thence North Eighty-nine degrees, Two minutes, and Fifteen
seconds East (N 89'02'15"E), a distance of Four Hundred
Eighty-one and Twenty-three Hundredths (481.23) feet;
- thence South Zero degrees, Zero minutes, and Zero seconds
West, (S 00°00'00"W), a distance of Eighty-six and Ninety-
two Hundredths (86.92) feet;
- thence South Eighty-nine degrees, Two minutes, and Fifteen
seconds West (S 89'02'15"W), a distance of Four Hundred
Eighty-one and Twenty-three Hundredths (481.23) feet;
- thence North Zero degrees, Zero minutes, and Zero seconds East
(N 00°00'00"E), a distance of Eighty-six and Ninety-two
Hundredths (86.92) feet back to the Point of Beginning.
The above described parcel contains Forty-one Thousand Eight Hundred Twenty-eight
(41,828) square feet or Ninety-six Hundredths (0.96) acres more or less as shown in Exhibit `B."
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the
drainage easement.
(c) Injustice to the Petitioner vacation of the drainage easement should be
granted.
Section 3. That the above described drainage easement is hereby vacated and full right of
use shall revert back to the following described tract owned by First Southern Baptist Church;
A tract of land in the Northwest Quarter of the Northwest Quarter (NW/4 of
NW/4) of Section Thirty-one (31), Township Fourteen (14) South, Range
Two (2) West of the 66' P.M., in Saline County, Kansas, described as follows:
Beginning at a point Five Hundred sixty-one and Twenty-three Hundredths
(561.23) feet south of the northwest corner of said Section Thirty-one (31);
thence on an assumed bearing North Eighty-nine degrees Two minutes and
Fifteen seconds East (N 89'02'15"E) a distance of Five Hundred Fifty-one
and Twenty-four Hundredths (551.24) feet; thence South Zero degrees Zero
minutes and Zero seconds West (S 00°00'00"W) a distance of Eighty-six and
Ninety-two Hundredths (86.92) feet; thence South Eighty-nine degrees, Two
minutes and Fifteen seconds West (S 89°02' 15"W) a distance of Five
Hundred Fifty-one and Twenty-four Hundredths (551.24) feet; thence North
Zero degrees, Zero minutes and Zero seconds East (N 00°00'00"E) a distance
of Eighty-six and Ninety-two Hundredths (86.92) feet along the west line of
said Section Thirty-one (3 1) to the Point of Beginning.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
