ORDINANCE NUMBER 00-10014
AN ORDINANCE PROVIDING FOR THE VACATION OF THE PLATTED
'RIOTED ACCESS ON NORTH OHIO STREET IN THE LINDFORS ADDITION IN
CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on December 11, 2000, the governing body conducted a public hearing
the petition of Tim Lindfors, ("Petitioner"), requesting vacation of the restricted access beginning
North Ohio Street on the West side of Lot One (1), Block One (1), Lindfors Addition.
Section 2. That the governing body finds from the evidence presented at the public
that due and legal notice has been given by publication as required by law, that no private
will be injured or endangered by vacation of the restricted access that the public will suffer
loss or inconvenience thereby, and that in justice to the Petitioner vacation of the restricted access
be granted provided however:
a) The property owner shall dedicate a restricted access along the West
side of Lot One (1), Block One (1), Lindfors Addition, except for a
Thirty (30) foot break which begins at a point forty-four (44) feet South
of the North property line and extends southerly to a point which is
seventy-four (74) feet south of the North property line.
Section 3. That for the purpose of recording this ordinance with the office of the Saline
Register of Deeds, this vacation of restricted access relates to that tract of real property
as Lot One (1), Block One (1), Lindfors Addition.
Section 4. That this ordinance shall be in full force and effect from and after its
and publication once in the official city newspaper.
