ORDINANCE NUMBER 00-10013
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF A
PLATTED DRAINAGE EASEMENT IN LOT 3, BLOCK 1, SCHILLING SUBDIVISION NO.
7, IN THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on December 11, 2000, the governing body conducted a public hearing
on the petition of Richard E. Brown on behalf of Smoky Hill, Inc., ("Petitioner"), requesting vacation
of a portion of the platted drainage easement in Lot Three (3), Block One (1), Schilling Subdivision No.
7, in the City of Salina, Saline County, Kansas, more particularly described as follows:
hearing that:
Commencing at the southeast corner of said Lot 3;
Thence S 89°54'25" W along the south line of said Lot 3, a distance of 50.00 feet
to the Point of Beginning;
Thence continuing along said south line, S 89°54'25" W a distance of 94.00 feet;
Thence N 04°02'44" E a distance of 828.35 feet;
Thence N 14'04'14" W a distance of 252.81 feet;
Thence S 47°46'32" E a distance of 128.50 feet;
Thence S 00°06'30" E a distance of 985.00 feet back to the Point of Beginning.
Commencing at the northeast corner of said Lot 3;
Thence N 88°27'21" W along the north line of said Lot 3, a distance of 64.02 feet;
Thence S 00°06'30" E a distance of 146.13 feet to the Point of Beginning;
Thence S 12'01'10" E a distance of 67.82 feet;
Thence S 00°06'30" E a distance of 36.94 feet;
Thence on a curve to the right having a radius of 282.00 feet, an arc distance of
163.08 feet, said curve having a long chord of 160.82 feet and a bearing of S
28°25'07" W;
Thence S 44°59'09" W a distance of 25.69 feet;
Thence N 00°06'30" W a distance of 66.16 feet;
Thence N 22'17'13" E a distance of 212.60 feet back to the Point of Beginning.
Commencing at the southeast corner of said Lot 3;
Thence N 00006'30" W along the ease line of said Lot 3, a distance of
1007.10 feet to the Point of Beginning;
Thence N 47046'32" W a distance of 128.50 feet;
Thence N 00006'30" W a distance of 14.23 feet;
Thence N 44059'09" E a distance of 4.93 feet;
Thence on a curve to the left having a radius of 332.00 feet, an arc distance
of 197.45 feet, said curve having a long chord of 194.55 feet and a bearing
of N 27056'54" E to a point on the east line of said Lot 3;
Thence S 00006'30" E along the east line of said Lot 3, a distance of 275.94
feet back to the Point of Beginning.
The above described drainage easements contain 87,142 square feet or 2.0
acres, more or less.
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the
drainage easement.
(c) In justice to the Petitioner vacation of the drainage easement should be
granted.
Section 3. That the drainage easement is hereby vacated and shall revert to the owners of
Lot Three (3), Block 1, Schilling Subdivision No. 7 in the City of Salina, Saline County, Kansas.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
