ORDINANCE NUMBER 00-10012
AN ORDINANCE PROVIDING FOR THE VACATION OF THE PUBLIC
STREET RIGHT-OF-WAY OF CHICAGO STREET FROM SOUTH STREET TO SPRUCE
STREET IN THE HOLIDAY ADDITION TO THE CITY OF SALINA, SALINE COUNTY,
KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on November 27, 2000, the governing body conducted a public hearing
on the petition of R.. Michael Bostater, President for Salina Building Company, Inc. ("Petitioner")
requesting vacation of the public street right-of-way for Chicago Street between South Street and
Spruce Street in the Holiday Addition to the City of Salina, Saline County, Kansas, more particularly
described as follows:
All that right-of-way for Chicago Street bounded by the north right-of-
way line of South Street and the south right-of-way line of Spruce
Street in Blocks 4 and 5 of the Holiday Addition to the City of Salina,
Saline County, Kansas
The above described right-of-way to be vacated contains twenty-six thousand five hundred
and thirty-three (26,533) square feet, more or less.
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the right-
of-way.
(c) In justice to the Petitioner vacation of the right-of-way should be
granted.
Section 3. That the right-of-way is hereby vacated and shall revert to the owners of Lots
10 through 16, Block 4, and Lots 1 through 7, Block 5 of the Holiday Addition in the City of Salina,
Saline County, Kansas, in accordance with K.S.A. 13-443, provided however:
(a) The City shall retain the entire sixty (60) feet of vacated right-of-way
as a utility easement.
(b) The property owner shall make site improvements which distinguish
the vacated right-of-way as a private driveway, including removal of
driveways, narrowed driveway openings, signage and installation of
landscaping.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
