ORDINANCE NUMBER 00-10007
AN ORDINANCE REPEALING ORDINANCE NUMBER 98-9896
REGARDING THE ACQUISITION OF CERTAIN REAL PROPERTY BY
EMINENT DOMAIN.
WHEREAS, On October 26, 1998, the Governing Body of the City of Salina,
Kansas adopted Ordinance Number 98-9896 which authorized the acquisition of fee
simple title to the real estate described on the Certificate of Engineer attached to the
Ordinance as Exhibit "A" for the purpose of improving the flood control system in
southeast Salina; and
WHEREAS, based upon appraisal data available to the City and a reassessment
of the proposed drainage improvement project, the Governing Body has directed city
staff to instead pursue the dedication of an additional fifty feet (50') of storm drainage
right-of-way along the west boundary of a tract north of Wayne Street for the purpose of
enhancing the detention and storage capacity of the existing drainage channel, SO NOW
THEREFORE,
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas, that:
Section 1. Ordinance Number 98-9896 is hereby repealed.
Section 2. This ordinance shall be in full force and effect from and after its
adoption and publication as provided by law.
