ORDINANCE NUMBER 00-10000
AN ORDINANCE PROVIDING FOR THE VACATION OF THE PLATTED
NORTH -SOUTH UTILITY EASEMENT LOCATED BETWEEN LOTS 4 AND 5, BLOCK 2,
BROCK ADDITION OF THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on September 25, 2000, the governing body conducted a public hearing
on the petition of Daniel C. King Trust ("Petitioners") requesting vacation of the platted North-South
utility easement located between Lots 4 and 5, Block 2, Brock Addition in the City of Salina, Saline
County, Kansas, more particularly described as follows:

The West ten (10) feet of the South one hundred six and sixteen hundredths
(106.16) feet of Lot 4, Block 2, Brock Addition and the East ten (10) feet of
the South one hundred six and sixteen hundredths (106.16) feet of Lot 5,
Block 2, Brock Addition to the City of Salina, Salina County, Kansas.
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the utility
easement.
(c) In justice to the Petitioner vacation of the utility easement should be
granted.
Section 3. Said easement is hereby vacated and shall revert back to the
owners of Lots 4 and 5, Block 2, Brock Addition in accordance with K.S.A 13-443.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
