ORDINANCE NUMBER 00-9997
AN ORDINANCE PROVIDING FOR THE VACATION OF A SEGMENT OF
'. PLATTED RESTRICTED ACCESS AND THE VACATION OF A PLATTED BUILDING
-BACK LINE ALONG THE EAST SIDE OF LOT TWO (2), BLOCK ONE (1), WATERS
DIVISION IN THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on August 21, 2000, the governing body conducted a public hearing on
petition of the City of Salina ("Petitioner") requesting vacation of the restricted access beginning
the northeast corner of Lot Two (2), Block One (1), Waters Subdivision, and extending south along
east line of said Lot Two (2) a distance of Ninety (90) feet, and vacation of a One -hundred Thirty -
le and Eighty Hundredths (139.80) foot building set -back line on Lot Two (2), Block One (1),
aters Subdivision.
Section 2. That the governing body finds from the evidence presented at the public
acing that due and legal notice has been given by publication as required by law, that no private
,hts will be injured or endangered by vacation of the restricted access and building set -back line,
it the public will suffer no loss or inconvenience thereby, and that in justice to the Petitioner
cation of the restricted access should be granted provided however:
a) The property owner shall dedicate a restricted access along the entire
east side of Lot Two (2), Block One (1), Waters Subdivision, except for
a Sixty (60) foot break which begins at a point Fifty (50) feet south of
the northeast corner of said Lot Two (2) and extends southerly to a
point which is One -hundred Ten (110) feet south of the northeast corner
of said Lot Two (2).
Section 3. That for the purpose of recording this ordinance with the office of the Saline
ty Register of Deeds, this vacation of restricted access and building set -back line relates to that
of real property described as Lot Two (2), Block One (1), Waters Subdivision.
Section 4. That this ordinance shall be in full force and effect from and after its
.ion and publication once in the official city newspaper.
