ORDINANCE NUMBER 00-9996
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF THE
EAST -WEST TEN (10) FOOT DRAINAGE AND UTILITY EASEMENT LOCATED IN LOT
NINE (9), BLOCK TWO (2) IN THE WOODLAND HILLS ESTATES ADDITION OF THE
CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on August 14, 2000, the governing body conducted a public hearing on
the petition of Darvin Dent, on behalf of Landmark Development Company ("Petitioner") requesting
vacation of a portion of the East-West Ten (10) foot drainage and utility easement located in Lot Nine
(9), Block Two (2), in the Woodland Hills Estates Addition of the City of Salina, Saline County,
Kansas. More particularly described as follows:
The North Two and Five Tenths (2.5) feet of the South Ten (10) feet of Lot
Nine (9), Block Two (2), less the East Ten (10) feet thereof, of the Woodland
Hills Estates Addition to the City of Salina, Saline County, Kansas.
The above described easement to be vacated contains Two Hundred Seventy-five (275)
square feet, more or less.
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the
drainage and utility easement
(c) In justice to the Petitioner vacation of the drainage and utility easement
should be granted.
Section 3. That the drainage and utility easement is hereby vacated and shall revert to the
owners of Lot 9, Block 2, Woodland Hills Estates Addition of the City of Salina, Saline County,
Kansas, in accordance with K.S.A. 13-443, provided however:
a) The Petitioner shall dedicate an additional Two and Five Tenths (2.5)
feet of drainage and utility easement on Lot Eight (8), Block Two (2),
Woodland Hills Estates Addition.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
