00-9991 Vac Frank Indust'l Area(Published in The Salina Journal August 11, 2000) ORDINANCE NUMBER 00-9991 AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF A NORTH -SOUTH UTILITY EASEMENT IN LOT 4, BLOCK 1, FRANK INDUSTRIAL AREA ADDITION OF THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on July 24, 2000, the governing body conducted a public hearing on the petition of Joe Frank, Jumpin' Joe's L.L.C. ("Petitioner") requesting vacation of a portion of the north - south utility easement in Lot Four (4), Block One (1), Frank Industrial Area Addition in the City of Salina, Saline County, Kansas, more particularly described as follows: Commencing at the northeast corner of Lot Three (3) in said Block One (1); thence North along the east line of said Lot Three (3) extended, a distance of Sixty (60) feet to the Point of Beginning; thence continuing North along said east line extended, a distance of Fifteen (15) feet; thence West and parallel with the north line of said Lot Three (3), a distance of Ten (10) feet to the west line of a platted Twenty (20) foot utility easement; thence South along the west line of said easement, a distance of Fifteen (15) feet; thence East and parallel with the north line of said Lot Three (3), a distance of Ten (10) feet back to the Point of Beginning. hearing that: Section 2. That the governing body finds from the evidence presented at the public (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by vacation of the right- of-way. (c) In justice to the Petitioner vacation of the right-of-way should be granted. Section 3. That the utility easement is hereby vacated and shall revert to the owners of Lot Four (4), Block 1, Frank Industrial Area Addition in the City of Salina, Saline County, Kansas. Section 4.
