ORDINANCE NUMBER 00-9988
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF THE
EAST -WEST TWENTY (20) FOOT DRAINAGE AND UTILITY EASEMENT LOCATED
BETWEEN LOTS FOUR (4), FIVE (5), TWENTY-FOUR (24), AND TWENTY-FIVE (25) IN
BLOCK TWO (2) OF THE WOODLAND HILLS ESTATES ADDITION IN THE CITY OF
SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on July 10, 2000 the governing body conducted a public hearing on the
petition of Darvin Dent ("Petitioner") requesting vacation of a portion of the east -west twenty (20) foot
drainage and utility easement located along the common lot line between Lots Four (4) and Five (5),
and Lots Twenty-four (24) and Twenty-five (25), in Block Two (2) of the Woodland Hills Estates
Addition to the City of Salina, Saline County. More particularly described as follows:
hearing that:
The North Ten (10) feet of Lot Four (4), less the West Ten (10) feet thereof,
the South Ten (10) feet of Lot Five (5), less the West Ten (10) feet thereof,
the North Ten (10) feet of Lot Twenty-four (24) less the East Ten (10) feet
thereof and the South Ten (10) feet of Lot Twenty-five (25), all in Block
Two (2) of the Woodland Hills Estates Addition to the City of Salina, Saline
County, Kansas.
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the
drainage and utility easements.
(c) In justice to the Petitioner vacation of the utility easements should be
granted.
Section 3. That the utility easement is hereby vacated and shall revert to the
owners of Lots 4, 5, 24, and 25, B1ockl�`Woodland Hills Estates Addition to the City of
Salina, Saline County, Kansas in accordance with K.S.A. 13-443.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
