00-9987 Vac Woodland Hills EstComoXtlabM1SeXne (Published in The Salina Journal JulyAl 2000) ORDINANCE NUMBER 00-9987 AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF THE TWENTY (20) FOOT DRAINAGE AND UTILITY EASEMENT LOCATED BETWEEN LOTS FOUR (4) AND FIVE (5) IN BLOCK THREE (3) OF THE WOODLAND HILLS ESTATES ADDITION IN THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on July 10, 2000 the governing body conducted public hearings on the petition of Darvin Dent ("Petitioner") requesting vacation of the east -west twenty (20) foot drainage and utility easement located along the common lot line between Lots Four (4) and Five (5) in Block Three (3) of the Woodland Hills Estates Addition in the City of Salina, Saline County. More particularly described as follows: hearing that: The North Ten (10) feet of Lot (4) less the East Twenty (20) feet thereof, and the South Ten (10) feet of Lot Five (5) less the East Twenty (20) feet thereof, all in Block Three (3), Woodland Hills Estates Addition to the City of Salina, Saline County, Kansas. Section 2. That the governing body finds from the evidence presented at the public (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by vacation of the easements. (c) Injustice to the Petitioner vacation of the utility easements should be granted. Section 3. That the utility easement is hereby vacated and shall revert to the owners of Lots Four (4) and Five (5), Block Three (3), Woodland Hills Estates Addition in the City of Salina, Saline County, Kansas. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
