00-9984 Vac Country Oak Estc.w�u., (Published in The Salina Journal September/12000) ORDINANCE NUMBER 00-9984 AN ORDINANCE PROVIDING FOR THE VACATION OF THE TWENTY FOOT EAST -WEST UTILITY EASEMENT LOCATED ON THE SOUTH TWENTY (20) FEET OF LOT EIGHTEEN (18) IN BLOCK FIVE (5) OF THE COUNTRY OAK ESTATES SUBDIVISION AND THE NORTH ONE HUNDRED AND FORTY FIVE (145) FEET OF A TWENTY (20) FOOT NORTH -SOUTH UTILITY EASEMENT LOCATED ON LOT SEVENTEEN (17) IN BLOCK FIVE (5) OF THE COUNTRY OAK ESTATES SUBDIVISION IN THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on June 19, 2000, the governing body conducted a public hearing on the petition of Daniel Huehl ("Petitioner") requesting vacation of the twenty (20) foot east -west utility easement located on the South twenty (20) feet of Lot Eighteen (18) in Block Five (5) of the Country Oak Estates and the North one -hundred forty five (145) feet of a twenty (20) foot north -south utility easement located on Lot Seventeen (17) in Block Five (5) of the Country Oak Estates Subdivision in the City of Salina, Saline County. hearing that: Section 2. That the governing body finds from the evidence presented at the public (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by vacation of the right- of-way. (c) In justice to the Petitioner vacation of the utility easements should be granted. Section 3. That these utility easements are hereby vacated and shall revert to the owners of Lots 17 & 18, Block 5, Country Oak Estates Subdivision in the City of Salina, Saline County, Kansas, subject to the following conditions: (a) The property owner shall dedicate a new utility easement west of the north -south easement on Lot 17 to accommodate the relocated utility systems. (b) This dedication and relocation shall occur prior to final approval of this vacation ordinance. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
