00-9983 Vac Holiday AddGraOliWpESetlne (Published in The Salina Journal October47 , 2000) ORDINANCE NUMBER 00-9983 AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF THE EXISTING CEDAR STREET RIGHT-OF-WAY EAST OF CHICAGO STREET AND THE FOURTEEN FOOT PLATTED UTILITY EASEMENTS IN BLOCKS 6 AND 7 OF THE HOLIDAY ADDITION TO THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That on June 12, 2000, the governing body conducted a public hearing on the petition of R. Michael Bostater ("Petitioner") requesting vacation of a portion of the existing Cedar Street right-of-way and certain utility easements in the City of Salina, Saline County, Kansas, more particularly described as follows: CEDAR STREET RIGHT-OF-WAY: All of the platted right-of-way for Cedar Street, except the west ten (10) feet thereof, located in the Holiday Addition to the City of Salina, Saline County, Kansas. Said right-of-way being adjacent to the north side of Block 6 and the south side of Block 7 in said Holiday Addition, and extending from a point ten (10) feet east of the east line of Chicago Street east approximately two hundred forty-seven (247) feet to the west line of the platted sixteen (16) foot alley adjacent to the east side of said Blocks 6 and 7, containing sixteen thousand and fifty (16,050) square feet, more or less. UTILITY EASEMENTS: All of the platted fourteen (14) foot utility easements in Block 7 and that portion of the platted north -south fourteen (14) foot utility easement in Block 6, beginning at a point thirteen (13) feet north of the south line of Lot 4, Block 6, and extending north to the south line of Cedar Street all in the Holiday Addition to the City of Salina, Saline County, Kansas. Section 2. That the governing body finds from the evidence presented at the public hearing that: (a) Due and legal notice has been given by publication as required by law. (b) No private rights will be injured or endangered by vacation of the right- of-way and utility easements. (c) In justice to the petitioner vacation of the right-of-way and utility easements should be granted. Section 3. Said right-of-way is hereby vacated and shall revert back to adjacent property owners in accordance with K.S.A. 13-443. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
