ORDINANCE NUMBER 00-9982
AN ORDINANCE PRQVIDING FOR THE VACATION OF A PORTION OF THE
EXISTING NORTH FIFTH STREET RIGHT-OF-WAY NORTH OF NORTH STREET AND
SOUTH OF THE UNION PACIFIC RAILROAD TRACKS IN THE CALKIN ADDITION TO
THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on June 5, 2000, the governing body conducted a public hearing on the
petition of Lonnie Wilson ("Petitioner") requesting vacation of a portion of the existing North Fifth
Street right-of-way in the City of Salina, Saline County, Kansas, more particularly described as follows:
hearing that:
North Fifth Street right-of-way bounded by the south property line
of Lot 35, Block 10, Calkins Addition, extended on the south and
the Union Pacific Railroad right-of-way on the north.
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the right-
of-way.
(c) In justice to the Petitioner vacation of the right-of-way should be
granted.
Section 3. Said right-of-way is hereby vacated and shall revert back to adjacent property
owners in accordance with K.S.A. 13-443 provided however:
(a) The City retains the vacated right-of-way as a utility easement.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
