ORDINANCE NUMBER 00-9979
AN ORDINANCE PROVIDING FOR THE VACATION OF A PORTION OF THE
TWENTY FOOT UTILITY EASEMENT IN LOT ONE (1), BLOCK ONE (1), WATERS
SUBDIVISION, OF THE CITY OF SALINA, SALINE COUNTY, KANSAS.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That on May 8, 2000, the governing body conducted a public hearing on the
petition of James R. Waters ("Petitioner") requesting the vacation of the twenty (20) foot east -west
utility easement in Lot One (1), Block One (1), Waters Subdivision in the City of Salina, Saline County,
Kansas, the center of said easement being fifty (50) feet south of the north line of said Lot One (1) and
extending from the west right-of-way line of Ninth Street west to the platted north -south alley adjacent
to the west line of said Lot One (1).
hearing that:
Section 2. That the governing body finds from the evidence presented at the public
(a) Due and legal notice has been given by publication as required by law.
(b) No private rights will be injured or endangered by vacation of the right-
of-way.
(c) In justice to the Petitioner vacation of the right-of-way should be
granted.
Section 3. That the easement is hereby vacated and shall revert to the owners of Lot 1,
Block 1, Waters Subdivision in the City of Salina, Saline County, Kansas.
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
