00-9975 Zone Country Oak EstConsolitlaie05alme r (Published in The Salina Journal May, , 2000) ORDINANCE NUMBER 00-9975 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF, AND AMENDING SECTION TWO (2) AND SUBSECTION THREE (3) OF SECTION FOUR (4) OF ORDINANCE NUMBER 93-9596. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PDD/C-3", PLANNED DEVELOPMENT/SHOPPING CENTER DISTRICT. That Section Two (2) of Ordinance Number 93-9596 and the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and they are hereby amended so that the following described property be rezoned as follows, to -wit: Lots Seventeen (17) and Eighteen (18), Block Five (5), Country Oak Estates Subdivision of the City of Salina, Saline County, Kansas shall become a part of DISTRICT "PDD/C-3", PLANNED DEVELOPMENT/SHOPPING CENTER DISTRICT. Section 2. CONDITIONS OF APPROVAL. Subsection Three (3) of Section Four (4) of said Ordinance Number 93-9596 is hereby amended so that the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "C-3", SHOPPING CENTER DISTRICT regulations and development of the property shall also be subject to the following conditions, to wit: 1) Uses in the commercial area designated as Lot Seventeen (17) and Eighteen (18), Block Five (5), Country Oak Estates Subdivision shall be limited to those uses permitted in the C-2 (Neighborhood Shopping) District plus hotels and motels. 2) Development of the site shall be subject to all bulk and use limitations of the C-3 (Shopping Center) District, except that a maximum structure height of up to thirty-four (34) feet for the motel building and forty-eight (48) feet for the tower feature shall be permitted. 3) Signage on the site shall be limited to wall signs which shall include north and east tower signs not to exceed nine (9) feet by twelve (12) feet in size without Planning Commission approval as a site plan amendment, and one monument sign not to exceed eight (8) feet in height. co�soi�aeiwsaow 4) Vehicle parking in the area labeled truck parking area shall be limited to recreational vehicles, extended cab pickups, trailers and rental trucks used for moving household goods. A sign shall be posted stating "No Semi - truck parking." 5) A detailed landscape plan identifying existing mature trees and containing a listing of proposed planting materials including the variety, quantity and size at the time of planting shall be submitted prior to issuance of a building permit. 6) The developer shall make every effort to preserve and protect the existing mature trees on this site where it is practical to retain them. 7) The platted utility easement west of the motel building shall be vacated prior to issuance of a building permit for any structure located within that easement. 8) A building permit for a motel shall be applied for within eighteen (18) months of the approval date or the approval development plan shall become null and void and the zoning shall revert to its former classification. 9) Development of the site, including building height and design, signage and landscaping, shall conform to the approved site development plan, landscaping plan and building elevation drawing presented on April 24, 2000. Section 3. That Subsection Three (3) of Section Four (4) of Ordinance Number 93-9596, as it relates to Lots Seventeen (17) and Eighteen (18), Block Five (5), Country Oak Estates Subdivision of the City of Salina, Saline County, Kansas is hereby repealed. Section 4. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
